In a phone interview with CEO Michael Ward on Wednesday - two days before the emergency order called for trains carrying oil or ethanol to slow down to 40 miles per hour while in congested areas - Ward said that the industry had already agreed to slow trains carrying oil to 40 miles per hour in high-risk areas.
