    Last month, a St. Joseph County judge ruled that convicted murderer and rapist Michael Dean Overstreet couldn't be put to death because he has delusions and hallucinations that disconnect him from reality. The judge said Overstreet, who raped and brutally killed Franklin College student Kelly Eckart in 1997, couldn't be executed until a court determines he's competent to understand why he's being killed.

    The state will not appeal a judge's ruling that determined a man who raped and murdered a Franklin College student is too mentally ill to be executed. St. Joseph County Judge Jane Woodward Miller determined last month that Michael Dean Overstreet suffers from severe paranoid schizophrenia and is not able to rationally understand what will happen when he is executed.

    Attorney General Greg Zoeller says he won't appeal a ruling that a man sentenced to death for killing a Franklin College student in 1997 is incompetent to be executed because such an appeal likely would not succeed.
