She was charged by the February 2012 Tyler County grand jury with two counts of felony daytime burglary and a misdemeanor charge of petit larceny.

Michael, of the Parkersburg Detachment of the West Virginia State Police, discovered, near the 11.0 mile marker, a Chevrolet Cavalier in the eastbound lane which appeared to have rolled several times, causing both occupants to be ejected. Through the course of his investigation, Trooper Michael determined that the vehicle had originally been traveling westbound before losing control.

Smith, 25, of Middlebourne, to his original sentence of not less than one nor more than 10 years in the custody of the Commissioner of the Department of Corrections for the felony offense of grand larceny. He was charged by the October 2013 term of the Tyler County grand jury with two felony offenses and one misdemeanor.
