A federal appeals court has reinstated a lawsuit accusing officials in a largely white suburb of Rochester of using race as a pretext to shut down a dance club, saying a jury might conclude the town used 'city kids' as a euphemism for black teenagers.

The 2nd U.S. Circuit Court of Appeals said Thursday a jury might find that the town of Henrietta officials were racially motivated to stop a business, Fun Quest, from staging teen dances after a March 2002 dance attracted up to 4,500 youths to a facility with an occupancy limit of 1,500. Read more
