Prestigious Military Law Commission Recommends Scrapping Sodomy Ban

The military's prohibition of consensual sodomy invites arbitrary enforcement and may be unconstitutional according to a report released by the Commission on Military Justice today. The Commission recommends repealing the ban. The report was sponsored by the National Institute of Military Justice and a committee of the American Bar Association, and was authored by a distinguished panel of judges, scholars and military personnel. It noted that military laws already provide an "adequate basis to prosecute any criminal sexual misconduct," rendering the sodomy ban unnecessary.

What's really amazing is the mililtary is still exempt from Supreme Court rulings- like the one that found sodomy laws to be unconstitutional.

What does it say about our country if our military members don't have the same rights as the civilians they are tasked with protecting.

Remember that the military is a fourth branch of government. Throughout history, he who controlled the biggest army often controlled the country. No branch of government can afford to piss off the military leadership too much.

The fact of the matter is that the President is Commander in Chief only as long as the Joint Chiefs don't mutiny. Clinton's attempt to overturn the ban on gay servicemembers was a grim reminder of that reality.

That may happen in other countries, but having served 20 years I can't believe for one minute that the military would actually mutiny and attempt a coup. Maybe I'm naive, but after 200+ years of civilian control over the military, it's highly unlikely. Hell, even during the run-up to the civil war the generals never tried to take over, they just left and joined the south.

Worst case scenario is some senior officers retire, and a few (very few) less senior officers will resign their commissions (giving up their pension). Same applies for the enlisted ranks, with the exception the junior enlisted will have to wait until their enlistment is up before getting out.

There are a lot of junior officers & enlisted members that would LOVE the opportunity to move up in rank & position. Sometimes the old farts just refuse to retire and that clogs up the promotion pipeline for everybody else.

I don't think a military coup is any more likely in the USA than you do. But the threat is always real.

Our system has been designed to elect officials who don't deviate as much from the mainstream as pundits often pretend. But if we were to elect someone like Hugo Chavez? He'd better make friends with the generals real fast.

I can see the law as far as guys having sex with sheep; and I can see it for guys and guys, but as presently written, the UCMJ article on sodomy makes it illegal if you pick up a hot chick in the club and get a BJ or even if your wife gives you oral.
That's just wrong. We'd all be convicted of sodomy if we can't legally get a BJ from a woman.
