Attorney: Teen's sentence is unconstitutional

The lawyer for Qu'eed Batts, who was 14 in 2006 when he shot and killed an Easton boy and shot another teenager in the back, says Batts' prison term of life without possibility of parole is unconstitutional.

Philip D. Lauer of Easton on Friday filed a petition in Northampton County Court asking Judge William F. Moran to allow him to raise the new issue. Moran previously rejected a request that Batts, who turned 17 last week, be granted a new trial or that his case be transferred to juvenile court. Read more

Commit the crime do the time, this lawyer should ask Clarence Edwards how many years he wants to live, o ya thats right hes DEAD. How about we let the kid go and put the lawyer in jail for life instead.

I agree, it's a long sentence, the lethal injection would be better. The taxpayers don't deserve to feed, house, and clothe this idiot for that long

What about the rights of the person this moron killed? What about the victims family and their rights? This young punk got exactly wjat he was asking for. Thats the problem with these young kids today...they think they can do anything and not have to face the consequnces.

Once again another lawyer is trying to get someone out of jail for murder and put them back into society. No wonder crime is so rampid in this country, noone ever does the time for the crime.

Phil Lauer will say anything at all to get somebody the 'feeling' of having representation while he collects from the state as a public defender.
He's a shirt!
The kid had no remorse, has no remorse and may NEVER have remorse, but since he wasn't found to have a mental defect, he's got to do hard time.
th ebest that they can do fo rthids kid is to keep himout of the general population for as long as they can.
But some crooked guard will let a dog jump into th epen and nail the kid eventually.
You can buy anything in the joint.
And the hiring standards are really low.

I agree with you 100%. Even though this 14 yr old boy regrets what he has done it doesnt bring the other one back. To have enough hate in you to kill anyone is just sad and a waste of your own life. Too many die young without being killed. If you have such an urge to kill someone why not make it yourself.. that way no one else has to pay for what you've done.... Im making this a T-shirt....

If you're in a violent gang and can kill others at 14, I would hate to see what this dirtbag would be capable of as an adult. Alot of good his gang status will do him in prison.

If you must release the kid do so on two conditions, first that attorney Lauer adopts him and raises him among his own children until he is 21 and second that Lauer assumes legal culpability in any of his new son's future crimes.
