The Attorney General is going try to do the legal equivalent of an end run around the precedent set in this case by appealling the findings of another case that also overturned the statute. I haven't been able to find the decision in the Miami case mentioned in the article, but I have found the decision here and whatever the findings were by that judge would have to be a heck of a lot easier to argue against than Judge Audlin's ruling. He invalidated the ban on two rather interesting grounds that had not been used in the Lofton challenge. The first is that the ban is an unlawful bill of attainder (punishment by legislative act), the extensive historical record of the measure's enactment that was admitted into evidence clearly showed that there was no consideration of what would be in the best interest of children going into this, merely an attempt to act punitatively against gay people. The second invalidation was that the statute is in violation of the separation of powers, the legislature improperly intruding on the role of the judiciary in its role of determining what is in the best interest of an adoptive child. What is particularly interesting about this story is that the adoption will be permitted to stand as the state has no intentions of appealling the findings of the judge in this case, however they are appealling another ruling that has invalidated the adoption ban in Florida as being unconstitutional. Something tells me that the state would lose badly if they tried to defend the bigotry of the law based on what is on the record in this case, but the AG believes that they can somehow defend against what was found in Miami...Hypocrisy in action, gotta love it. I really don't mind breaking this to you, but it is you who are wrong, again. That freedom of religion that you hold so dear also equates to a freedom from religion. Atheists do have the right to sue on the basis of religious discrimination and over the years have been rather successful at it. What you refuse to acknowledge in all the examples provided to you is that people of faith who have been granted permission to sign off on marriage licenses and the places of worship where they perform such ceremonies are protected by their freedom of religion from all manner of intrusions into their religious beliefs. Catholic Priests and churches cannot be sued for denying someone who is divorced from marrying just as any Priest, Reverend, etc. and their places of worship cannot be sued by atheists, same-sex couples or anyone else who is excluded by religious doctrine from being married there or by the officiant. All you would need to do is site even one successful lawsuit in this area to prove your point, but despite all of your protestations that there are going to be lawsuits, there are going to be lawsuits, you haven't given us one (11 hrs ago | post #310)

There are Christian denominations that support and bless same sex marriages, I attended my first more than twenty-five years ago and they are still happily married in the eyes of God. Although I'm not a big fan of these kinds of hate speech laws, this is a case where if there going too be used they should be used to their fullest extent. This bozo just got his biggest headline he has in the last 5 years of his attempts to run for office, the only other story I found on him was when I posted another version this story last week, was where he was convicted of assaulting his own mother back in '03. Mr Popescu is the ultimate in fringe candidates, the last two times he ran for office, he finished dead last and has yet to manage even 1% of the vote, I really doubt statements like this are only going to make him any more popular than he already isn't....
