The prosecutor has a duty under the law of Rule 16 discovery and Brady v. Maryland that ALL exculpatory evidence IS TO BE formally turned over to the defense. In this case, the prosecutor CHOSE to put these 19 or so pieces of exculpatory evidence into a box, throw it in his office and never formally turn it into the defense, which he has an ongoing duty to do. No, the first defense attorney's were not completely at fault for Bob and Randy's miscarriage of justice. The Portage County prosecutor (David Norris) and his "team" (Muldowney, Buchannen and Ron Craig) were right along with him. It was called "hide and seek." PC had exonerating evidence that could've cleared B&R, but "hid: it and expected the defense attorney's to go "seek" through the files. Well, it's hard to find something in a file that isn't there to begin with. Then when someone lies on the stand at an evidentiary hearing that they gave ALL evidence to defense attorney's (hand delivered it, if I remember the wording correctly), what is the judge going to do? Call the Prosecutor/team liars? It's PC words against the defense attorney's. Why in the world would B&R's seasoned defense attorney's, if they had ALL the evidence, NOT use it when your client(s) are facing the death penalty??!! Doesn't make sense, does it? You are correct. Just because someone does time in prison doesn't mean they are "innocent. " Even though B&R ARE innocent, they have to go through ANOTHER civil trial (very extensive AND expensive) to get a "Declaration of Innocence." The problem NOW, politician, is that they are now facing Portage County AGAIN after all the miscarriages of justice for almost 20 yrs. The very county and officials that stalemated them from getting fair trials in the first place. I will predict that after about 3-4 years, this civil suit will end up before the Ohio Supreme Court. Chief Justice Moyer should be apprised that PC is up to their old antics again. He's (CJ Moyer) GOT to be thinking, "What is going on up there in Portage County AGAIN?!" (Jun 12, 2008 | post #42)

For Judge Pittman (who was blatantly for the prosecutions side during Resh's trial last year) to rule that Gondor and Resh must sue "the prosecutor's office" just doesn't jive with the law. The Prosecutor's office has "sovereign immunity" and CANNOT be sued directly. The State of Ohio/Attorney General's office must be the office that the lawsuit is brought against. It isn't like this is the first wrongful incarceration civil suit to ever be filed in Ohio. Of course myself and anyone who knows ANYTHING about this case or Portage County realizes that the corrupt "powers that be" are ONCE AGAIN setting up roadblocks to keep Gondor and Resh from receiving any type of compensation. I think many times people don't understand what it means to "forgive. " It's the other person saying, "I CHOOSE to forgive you for ME. So that I can get on with my life and not let hatred and bitterness hold me captive." It DOESN'T absolve the guilty party of their responsibility for their actions. I know someone who was in prison for over 17 years. He served his time over 3 prisons in Ohio. He is the one that would know... There are pedophiles in prison and no one tries to kill them. Even a prist that abused children. He's left alone. If you keep to yourself and keep your mouth shut, you do fine. So, yes "never a hero", he'll go to prison and he'll be fine.
