You may or may not be an Officer. If you were, you would know that Trooper Bowers did not know she was a Police Officer until the next day. She NEVER BADGED him. Do not start trouble where none is needed. She was wrong and she will get through it. Chief Barber knows the law and she has been accused of breaking it. There are a lot of pieces missing from this story. Brandon, the Virginia code 18.2-61 gives the definition of Rape. Intoxicated could be replaced with Mental Incapacity or Physical helplessness. I guess it would depend on how DRUNK she was. Were you there, lets play "what if" What if the Officer did turn to flee or never saw the Dog. What if he fell as the dog got to him or even after. What if a decent size dog was chewing on your shoulder. Anatomy and the mirror tell me the neck and head are also with in range. But We can play "What if" all day. If you relieved me of duty for doing my job of chasing criminals, I'd tell you what an idiot along with a few unspeakable word for this forum and give you a real reason to try to punish me. Well, not being a K9 Officer, but knowing many.. THey never release their dog with out loud verbal warnings. Also If they cannot see the suspect, they won't release unless its a confined/controlle d (surrounded by other officers) area. Also I don't know if you've ever gone to a K9 Demo. Our dogs are well trained to release immediatly on command of the handler. No if your in your yard and a Dog, Police or not, and are being attacked, and there is noone there yelling commands to you or the dog........... I say do what you need to prevent "Serious Bodily Injury or Death" Take your chances if it comes to that presenting a case to a court, not with a 100 lb plus dog.  (Jan 19, 2008 | post #72)

Like a few people have said, every situation is different. If is had the opportunity to flee from the dog, then I would. But, if I had the misfortune to get caught by a dog, I would have to treat it like a normal threat. This includes deadly force. Do not get me wrong, but pepper spray does not over come the dogs will to bite. Is a person is angry enough, they to will fight through the effects of OC spray. And a Baton means drawn out contact with the dog. Hit the dog and it will recoil and react coming forward faster that most people can start a back swing.
