You are technically, and ultimately right,but; Sorry, it is not a soldier's job to interpret the constitution in his orders. The meaning of lawful orders is spelled out in the military regulations and Uniform Code of Military Justice. A test of your theory was just made by Army Lt.Ehren K. Watada.
