Not a word. I'm surprised some good major news magazine (or even a bad one) hasn't done a story on this case. This is really extreme. When was the last time that many people were murdered at one time? I keep expecting someone to break the case and find the killers and motive. The Next Step: I am woefully ignorant of our court system. It would seem that Federal Law trumps Georgia law every time. What are the steps involved. We have had - The Grand Jury Indictment -The Arrest -The arraignment where Guy Heinze was officially charged Now who make the first move to set a trial date? The prosecution has to have all it's ducks in a row and all of it's evidence in. It has to share that with the defense. Re: Pegmann's comment: That is exactly what I thought. Public Defenders don't have the resources (or usually time or interest) to mount the kind of defense the defendant deserves. It has always really bothered me that there is one system of justice for the very rich and another for the rest of us. What was OJ's bill? Assuming all of us are of average income and a few well above average - You can't afford a long lawsuit or a proper defense. Only accidents where the lawyer gets a fixed percentage of the award (see their TV advertisements ) will talk to you without substantial money down and the bill only goes up from there. An exception seems where you have a very high profile case a lawyer or group will take the case on for the publicity - pro bono Georgia has a special system for people accused of Capital Crimes only. It is called The George Capital Defenders. http://www.gacapde f.org/ This office is defending Guy Heinze. Harrison ( his first court appointed attorney) may be the "lawyer of record" If it is as good (and expensive) as people say then I think Guy is in good hands. I read an editorial from Georgia where a man was complaining about the huge expense of "defending criminals" Guy Heinze is not a criminal. He has been arrested but convicted of Nothing. Re: Byron Jimerson age 3. They did say he had been moved to a rehabilitation hospital. It is probably not admissible evidence but can't the average three year use some words like "doggy bite me" "I want a cookie" or "Guy not hurt me" Does that make sense or is three years old too young for words?  (Wednesday Dec 16 | post #241)

Remember any talk here that Guy Heinze was disabled started as a simple question. He is not. As Sunshine points out; Michael Toler had Downs syndrome which is physically very obvious. I'm no judge of male beauty but I agree that Guy has well above average looks. He also appears very physically healthy and certainly does not have Downs Syndrome. Guy Heinze (only from my perspective) has a very thick Southern accent. of course he would say. I'm the one with the Northern accent. =;-) His voice on the 911 call clearly sounded to me like someone totally traumatized, confused, tearful, garbled, not sure what to do, shocked, repulsed . God only knows how I would sound under similar circumstances. I think he was brave to go back into that bloody nightmare a second time to try and save a life - when it appeared all were dead. His footprints will be all over the bloody floor but that can't be helped. Guy was not thinking of preserving the crime scene. Only I have the luxury of that thought watching this unfold on CNN on September first from the safety of my armchair. God bless all 10 victims.  (Wednesday Dec 16 | post #238)

Sounds cold in Union Montana and it's cold here in Boston. This "topix" changed my town a couple of times too. Come to think of it I don't know much about "Topix" we use. Is it a national thing - message boards for every topic ? Maybe a Georgia based board? My general idea was the same as yours as to their proximity. The trailer park seems large but the manager, mike the maintenance man's and the Toler trailer were all "in back" and close to one another. They just got to each other very fast in the 911 tape. It sounds like "the back" was the least desirable and run down part of the park. Maybe the old section? I may be just imagining that though. The Toler trailer looks really run down compared with New Hope Plantation Trailer Park photos on the Internet.  (Monday Dec 14 | post #228)

Thank you "Out of State Reader- Union MO (Sharon?) for the undeserved complement but my being a bit obsessed with this case certainly doesn't make me an expert. Listening to the 911 case IMO it sounded as if the manager's trailer was very close by the Toler trailer and It "seemed" that the cell phone (if in fact the call was made from her cell phone) was then passed to the maintenance man who stood outside the Heinze/Toler trailer as Guy went back in for the second time screaming for an ambulance and saying "he's breathing" The maintenance man on the phone (a phone anyway ) Seemed very normally to have no intention of going in that trailer even before the 911 operator told him not to. I'm going back once again and listening to the 911 call. If it was two phones we should be able to hear that. Thanks All for contributing ! Greg - Responding to this post: I think the one that did it went in the opposite door that dog was at they were one post where someone stated that dogs were constantly barking around there. One more thing that did not sound right one call was make and he was at the landlords house I thought and another he was talking on the phone from the maintenance man's residence. Hi OOSR ! Thank you for the nice email. I hope you were able to open the 911 call transcript in PDF form. I got similar impressions. One call from the Manager's trailer porch (I think) and the other - (same cell phone?) handed to the maintenance man outside The trailer after Guy had gone back in to help his cousin. My understanding from the transcript was that the lady manager had a dog she was concerned about and the Heinze/Toler dog was tied in front of their trailer and she was concerned about it biting too. Are there no friendly dogs out there? Seriously I thought the remark from Wise1 sounded true. Any dog would bark like crazy while there was any activity while it was tied outside. Barking dogs in the trailer park may be like car alarms here. It's such a usual noise we just don't really hear it anymore.  (Sunday Dec 13 | post #219)

Guy Heinze sounds like someone who is simply terrified,confused and horrified. God only knows how I would sound on a 911 cal having made that gruesome discovery. News seeks to protect public access to caseTHE BRUNSWICK NEWS, GA. | MARY STARR | Tue, Dec 8, 11:43 AM Dec. 8--The Brunswick News has asked a Glynn County Superior Court judge to reject requests by lawyers for accused mass-murderer Guy Heinze Jr. to bar the public from pre-trial hearings in the case and to prevent lawyers and police from talking about it publicly. David Hudson, who practices at the Augusta firm of Hull, Towill, Norman, Barrett and Salley in the area of guaranteeing citizens' access to public records and proceedings, filed the motion on behalf of The News. Judge Amanda Williams has not ruled on the defense lawyers' request to close hearings and for a gag order or The News' request to maintain public access. Heinze, 22, was indicted Sept. 14 for the murders of seven family members and a friend in a trailer Aug. 29 at New Hope Plantation and the attempted murder of the 3-year-old son of one victim. "While lawyers are entitled to try to use any means properly at their disposals to ensure fair trials for their clients, it is unnecessary in this instance to deny the public access to facts that will be presented in a controlled courtroom proceeding," C.H. Leavy IV, president and editor of The News, said. "Judge Stephen Scarlett demonstrated during the pre-trial proceedings and trial for David Edenfield that it is possible to balance the rights of having both public and fair trials," Leavy said. The News successfully opposed a similar request to close proceedings for David Edenfield in the murder of 6-year-old Christopher Michael Barrios Jr. Scarlett, who presided at that trial, kept all proceedings open and empaneled jurors from another county for the trial to ensure that they had not formed opinions on the case. The jury convicted Edenfield on all counts. Hudson, in his motion to preserve public access to proceedings in the Heinze case, cited numerous judicial opinions that uphold the public's right to be present at criminal proceedings. "In the present case, routine media coverage of a criminal case of great importance to the community comes nowhere close to being 'clear and convincing proof' that only the closure of pre-trial hearings will protect the rights of the defendant," Hudson wrote in a brief filed Friday. He noted that courts recognize jurors may have knowledge of a criminal defendant and the matters about which he is charged. "The mere fact that there has been and may be more publicity about the Heinze case and that prospective jurors may be exposed to it is insufficient as a matter of law to establish prejudice to the defendant. Were this not the law, high-profile defendants such as Scooter Libby, Timothy McVeigh, Charles Manson, Sirhan Sirhan, O.J. Simpson and Brian Nichols, to name just a few, could never be tried by jury." Those cases drew national attention with charges involving, respectively, identifying a CIA agent, the Oklahoma City courthouse bombing, a mass murder, the assassination of presidential aspirant Robert Kennedy, a multiple jealousy killing and murders at the Fulton County, Ga., courthouse. Hudson contended that procedures other than barring the public from proceedings are available to protect a defendant's right to a fair trial. Jury selection, for example, would reveal any potential juror who was prejudiced and, in the unlikely event that a fair jury could not be selected in Glynn County, a trial could be conducted elsewhere. In seeking to close pre-trial proceedings, Heinze's attorneys have argued that he has received highly prejudicial publicity. Glynn County police contend that Heinze acted alone in the massacre in the mobile home, where he also lived. Glynn County Police Chief Matt Doering said in September, following analysis of evidence by the state crime laboratory, that all of the victims had been beaten to death.  (Friday Dec 11 | post #209)

Just picturing that much damage to anyones face is sickening. I saw a car accident victim in that state on the Internet once and still can't get it out of my mind. Suffice to say I guess I agree with both of you and at first glance (at least by me) it would be impossible to say. Spatter patterns or lack of them may have clued in the police right away though. Guy Heinze would of course not know of such things. Please - Is there ANY new information out there? I know I may sound like a broken record but someone (knowledgeable or not) must have given an interview ? A family member concerned? Sad? thinks Guy is guilty or Innocent ? There is nothing new since early September and precious little of that. I am fascinated by the case but it's like a mystery novel where I only read the first chapter or two and lost it. Surly the police even convinced of Guy Heinze's guilt would be looking for an accomplice? A motive? All I have is Police Chief Doerring saying with complete certainty that they have the murderer and two pieces of very important (undisclosed to the public) evidence. Legally this would have to be shared with the defense right away. (but then they want no publicity either). This is driving me mad. A lawyer friends ballpark guess about a trial date was over 8 months ! And that is in keeping within the law that we are all afforded a speddy trial. Just a couple of points 1) If the killer was not Guy Heinze I am not saying the person(s) responsible were strangers either to the trailer or members of the families. 2) Listening to the 911 tape the lady speaking ( Mobile home park manager) warns Guy that her dog might bite and then later speaks of the dog (Buddy I think his name is) at the Toler/Heinze trailer and her concerns that dog may bite as well. The dog is an issue no matter who did it - it would have barked. The dog may be very familiar with many people (non family) and not been a problem for the killers. There was also a front and a back to the trailer and the dog was tied in front. Dogs barking there may be as common as car alarms are here - so routine we hardly even hear them much less react to them. Whichywoman "Ahhh, but they DO talk. You supporters of Heinze just don't want to hear what the people here are saying." Also, I do, very much want to hear what people are saying no matter who they think is guilty. Google searches and other search engines turn up nothing. There are the murders, Guy's arrest and the police's statement about their search warrant. If anyone else is talking about the case within a stones throw of having any opinion or little fact - anything to add I would love to hear it. Please post a link  (Sunday Dec 6 | post #203)
