Appeal from members of Tingley family dismissed

Top court turns down Tingleys' challenge of disclosure decision July 12th, 2011 / By ADAM HURAS / The Daily Gleaner,Fredericto n, New Brunswick http://dailygleane r.canadaeast.com/c ityregion/article/ 1422755 The Supreme Court of Canada has denied a request by members of the Salisbury Tingley family to appeal a decision that withholds police documents that led to their arrest. The result could lead to an appeal after the case goes to trial, a date that's still yet to be determined after being postponed for the fourth time earlier this year and is now almost three years in the making. In December 2008, eight members of the Tingley family were arrested when more than 100 RCMP officers stormed several locations in Salisbury, near Moncton. The arrests were made after a year-long investigation and led to 57 counts, including conspiracy to traffic in cocaine, OxyContin and marijuana; weapons charges and operating an organized crime ring. Four members of the family remain charged in the matter, although none remain in custody. New Brunswick's Court of Appeal had first denied the family's request to release documents related to their arrests so they could better defend themselves in court. Federal law gives the government the right to withhold those documents. The Supreme Court has now dismissed the family's application to appeal the New Brunswick decision before trial. "The New Brunswick Court of Appeal said they wouldn't hear this appeal at this time," said defence lawyer Alison Menard. "It doesn't mean it's dismissed, what it means is that they won't hear it before the trial ... That issue would end up being an issue on appeal after the trial." Menard said the appeal could reappear after the conclusion of a trial, resulting in a retrial if successful. "If we go through the entire trial and the accused were denied documents that were relevant to their defence, then they may appeal after the trial that their trial was not fair," Menard said. "It's a good question to ask: why would you go through a six-month trial knowing that there may or may not be documents out there that should be provided to the defence and then potentially have to go through the entire thing again and have a new trial if it was a mistake?" During the investigation, police obtained permission to intercept telephone lines and search warrants to gather evidence through information from secret informants. The trial for four members of the Tingley family was last set to begin in February. It was the fourth start date for the trial, but each one has been adjourned because the matter wasn't ready to proceed. Defence lawyers in the case are still making applications and pre-trial motions, forcing further delays. A start date for what was once believed to be the makings of the largest and longest trial in New Brunswick history still isn't in sight.  (Jul 12, 2011 | post #2)

Police officer Garrett Styles killed after being dragged ...

Girl denies blame in cop's death By Michele Mandel ,Toronto Sun, June 30, 2011 http://www.toronto sun.com/2011/06/30 /girl-denies-blame -in-cops-death NEWMARKET - It’s not her fault. Or so insists one of the teenage joyriders in the minivan that rolled and crushed Const. Garrett Styles this week. In the face of a tumult of criticism that’s being unleashed upon her on social network sites, she’s reportedly trying to defend herself, telling everyone that she was sitting in the backseat and unaware the driver was underage and unlicensed. And she maintains there was nothing she could have done to stop the 15-year-old’s foolhardy bid to escape but is sorry the York Regional Police officer was killed as a result. Her former schoolmates are not impressed by her less than fulsome expression of remorse. The infamous teen is the talk of the neighbourhood around her former high school. They say she’s been openly posting about it to her friends. “It’s all over her Facebook page that it’s not her fault, ‘What was I supposed to do?’” recounts a Grade 11 student at the teen’s former high school. “But she’s basically trouble. Wherever she is, trouble follows.” “The general consensus is that they were pretty high at the time,” says one mother familiar with the teens. Those who know her aren’t surprised that she got mixed up in this senseless death or that she refuses to take any responsibility for what happened. “She’s pretty troubled,” the former schoolmate says. “She’s really into drugs and into partying. We just saw her at a fair a few weeks ago and she was completely wasted. All she could talk about was how she got kicked out of school and that it sucks.” The teen is widely known because she was expelled from her high school and according to the students who know her, notorious for drug use and promiscuity. “She’s just a bad person,” says another former classmate. “She’s pretty much drunk most of the time and does a lot of weird things.” “She would come to school dressed really inappropriately,” adds her boyfriend.  (Jun 30, 2011 | post #4)
