Correct. The legacy he claims he was leaving for his family they've been slowly building in the Highland Square area. All of this grandstanding was to get as much money as he can out of his toilets over near UofA.  (Sep 2, 2008 | post #48)

I agree they never intended on staying. Manny's is full it as well. A check of Summit county records shows his properties have been changing hands in recent years and he got it back in my opinion because he knew UofA wanted it for the stadium. That would be UofA Batgirl. In addition to the $1.3 million for the real property, the university also will pay $250,000 in litigation-related expenses and $550,000 for other compensation expenses included within the intent of Senate Bill 7 provisions, for a total of $2.1 million, which is $500,000 less than the jury verdict. The Nemers get 1.3 mil. The other 800,000 is their expenses. The original court award of 3.1 mil didn't include expenses and was just for their property alone. The Nemers come out of this with 200,000 more then they were originally offered. IMO, had they negoiated for 1.4 or 1.5 mil instead of 3 mil. They would have gotten that amount without the legal hassles.  (Sep 2, 2008 | post #42)

Joe and Mona Nemer will get 1.3 mil for their real property. The other 800 k is attorney fees and expenses. Their attorneys get 500,000 and their other litigation-related expenses came to 300,000. They're only getting 1.3 mil for their real property which only 200,000 more then the original UofA offer. While it comes to 2.1 mil total. Joe and Mona Nemer are only getting 1.3 mil for their property which is in line with the original appraisals.  (Sep 2, 2008 | post #39)

That doesn't mean when you several people together with differecnt backgrounds that their overall opinions are flawed. I have an Uncle who was an attorney and he told me years ago studies found that 75% of all jurors have their minds made up before they've heard one shred of evidence or seen any testimony. Most high profile cases or lwasuits you're working to convince a 1/3 of the jurors. Jury duty is not like TV and it can be the most boring thing you'll ever do in life. I don't know many people that want to spend 7 to 8 hours a day listening to someone talk about property values and sells. I'm sorry. But, most people I know that are summoned would rather have a root canal done.  (Aug 29, 2008 | post #53)

Anyone that thinks juries get it right all the time. They must agree with verdicts rendered by the OJ jury and the Michael Jackson jury. Juries are notorious for being more then a bit strange. Please keep in mind the average person with common sense tries to get out of jury duty and not serve it. Don't let TV fool you. Jury duty is one of the most boring, tedious and mundane things you'll ever do. Most jurist have made up their minds before they even hear one piece of evidence. This is proven fact. Bottom line is I wouldn't be all that shocked by who served on this jury not being the sharpest tools in the box.  (Jun 30, 2008 | post #15)

The jobs UofA has added to the City far beats the few that have been lost. Odd Corner relocated right across the street and there many other loactions nearby Joe and Manny could relocate and had they worked with UofA to that end. It could have gotten done. The University of Illinois in Chicago was another 98% communter school that starting building dorms about 10 years ago. Despite being surrounding on some sides by some very tough rundown areas of Chicago. (If, anyone here ever watched Hill St Blues. The Police precinct they used was right next to the school's campus) They can't build these dorms fast enough to meet demand and they've transformed an area 10 times rougher then the area near UofA.  (Jun 23, 2008 | post #73)

That's my whole problem with the jury verdict. UofA has been buying property in that area going back to when I still lived in Akron and that's been 25 years and counting ago. Compare the property value to what they paid Odd Corner, Mcdonald's and others who used to be on Exchange. Not what the City of Akron paid Brubaker's and Jillians on Main St.  (Jun 23, 2008 | post #51)

I'm sorry. But, I respectfully disagree with you. A jury found for Joe Nemer and based their decisions on what property on Main St went Vs what business right next door to them sold for in recent cases. Just because UofA wants it. Doesn't main you make it far higher then the FMV they could get if they tried to sell it. I for one hope Judge Spicer rules this jury erred, because IMO they did just that.  (Jun 22, 2008 | post #40)

These properties in question are not on the stadium footprint. These properties were needed for much needed dorms. I have no problem with eminent domain provided the property owners are offered FMV and compenstation for their property. I'm sorry but, Joe and Manny Nemer are not paying taxes for property worth what the jury awarded and that plain simple greed on their parts. The business are dumps and dives that have been going downhill for years. If, the business strip wasn't so blighted. I might feel more for them with UofA using eminent domain. But, I've seen these businesses first hand unlike many who post here. They're not even close to worth waht the jury awarded and are blights on Akron landscape. If, you won't fix it up.
