A consent form is not a "get out of jail free card". Now I am not saying this happened, but in front of a Jury if the family can present evidence that the physician or facility deviated from the standard of care then the family can claim that the procedure went beyond the consent, in which case the doctor or facility may be held liable. Exactly, that is a double-edged sword. You cannot rush to unquestionable innocence either. I would expect people to scrutinize me if I was involved with an undesirable outcome. Peer review will determine if standard of care was meant, but Peer review is not a civil court. You know and I know that the burden of proof is substantially lower in that regard.
