Arrested in Flemington, man owes child support, faces deportation to Mexico.

"FLEMINGTON — Flemington police and the Hunterdon County Sheriff’s Office received information that a person wanted by the Sheriff’s Office and federal Immigrations and Customs Enforcement was possibly at a restaurant on Broad Street in Flemington.

Officer Jeffrey Scanlon and Detective Jesse Winfield went to Viva Mexico on March 8 at about 7:30 p.m. and after a brief search of the premises they located Ismael Ballesteros, 37, formerly of Flemington, drinking beer with friends outside of the kitchen of the establishment.

He was arrested on an outstanding non-support warrant issued in Hunterdon County in 2011 in the amount of $1,737. Detective Winfield then contacted an agent of the ICE Criminal Alien Program to establish Ballestero’s immigration status.

ICE reported that he is banned from the United States after he had been deported to Mexico several times. Ballesteros was then lodged in the county jail on the child support warrant and ICE placed an immigration detainer on him so he can be held until he can be brought before an immigration judge. Detective Bill Svard and Cpl. Bob LaMothe of the Flemington police assisted at the scene."

FRAMINGHAM — 12 March 2012

"A Framingham man wanted for attempted murder since November was arrested on Friday when he was a passenger in a sport utility vehicle involved in a hit-and-run crash, authorities said.

Joel Lopez-Pojoy, 33, had been wanted since November after he attacked his girlfriend, prosecutor Melissa Baima said yesterday in Framingham District Court.

Lopez-Pojoy was a passenger in a Mercury Mountaineer, driven by Santo Amador, 41, of Framingham, who was also arrested, police said.

On Friday, Framingham police went to Greenview Street at 4:45 p.m. and spoke to a woman who said someone had crashed into her parked car and drove away. Baima said it appeared someone had driven over the lawn and through some brush before hitting the car.

While a police officer spoke to the woman, the Mountaineer, with mud and wood lodged in its front grill, approached.

The officer tried to stop the SUV, but it accelerated, the prosecutor said. The officer jumped out of the way to avoid being hit, Baima said.

The officer chased the SUV and pulled it over a short distance away.

Amador was behind the wheel and Lopez-Pojoy was a passenger. Baima said Lopez-Pojoy was drinking alcohol in the SUV, so police ran his name in the computer and discovered he was wanted by police.

The warrant for attempted murder and assault and battery stemmed from an incident in November in which police allege he slapped his girlfriend and slammed her to the bed.

“He has been in the wind since Nov. 21,” Baima said.

Along with the warrant, Lopez-Pojoy, of 6 Greenview St., was also charged with drinking from an open container of liquor in a vehicle.

Amador appeared to be drinking and was arrested. At the police station, he took a Breathalyzer test that registered a .19 blood alcohol level. He refused to take a second test, which is required, Baima said.

Amador was charged with OUI, leaving the scene of an crash and malicious destruction of property worth more than $250.

Amador also had a federal Immigration and Customs Enforcement detainer warrant for his arrest.

Baima requested $500 bail on both men. Judge Robert Greco agreed with the request.

If Amador posts bail, he will be taken into federal custody.

Lopez-Pojoy is due back in court on April 5 for a pretrial conference, while Amador is due back in court on April 12."

"CHARLOTTE, NC (WBTV)- Illinois Congressman Luis Gutierrez took to the microphone Tuesday, speaking in both English and Spanish, hoping to bring attention to the case of Gabino Sanchez.

"Gabino is a father of two American citizen children, he's a good man who had done nothing other than to try and provide for his family," said Gutierrez.

Sanchez came to the United States illegally from Mexico when he was just 14 -years-old.

The 27-year-old from Ridgeland, South Carolina was arrested last year for speeding.

He's also been arrested six times for driving without a license.

Today, he appeared in a Charlotte immigration court for his deportation hearing.

His case has made national headlines.

Last year, President Obama announced the U.S. Department of Homeland Security would focus on deporting illegal immigrants with criminal records. Sanchez does not have a record, which is why Representative Gutierrez says he should be allowed to stay in the U.S.

"He is not a criminal and that is what we need to make clear," said Rep. Gutierrez.

Not everyone agrees with Representative Gutierrez. Mecklenburg County commissioner Bill James says the law on immigration is clear.

"If the individual broke the law by coming into this country, then he should suffer whatever the penalty is under the law and if that is deportation then that is what they should do," said James.

But Gutierrez says his crusade to keep Sanchez with his family is just getting started.

Sanchez's deportation hearing was continued until May 15.

Gutierrez plans to return to Charlotte for the hearing in May."

Someone is being shipped home everyday. The sad thing is they come back, find work for 10 years then get picked after they have a family and house and car payments then go to prison and then deported again.

There will never be a shortage of illegal aliens to deport.

Some 44,000 people were deported from the United States after being convicted of traffic offenses during the first 10 1/2 months of fiscal year 2011, according to partial figures from the U.S. Immigration and Customs Enforcement."

Illegal aliens were not deported for traffic violations, they were deported because they were in the country illegally and then go out and commit traffic violations.

BROWNSVILLE — U.S. Immigration and Customs Enforcement officials aren’t saying much about armed agents descending on a local restaurant Wednesday evening and apprehending a group of men at gunpoint.

But the U.S. Attorney’s Office announced Thursday the arrest in Brownsville of six men on bribery charges — accused of trying to ensure safe passage to Mexico of Gulf Cartel member Juan Carlos De La Cruz Reyna, who was about to be released from prison in the U.S. De La Cruz was also arrested.

U.S. Attorney Kenneth Magidson said in a news release that the investigation began last May and involved a bribe of $1 million, most of which had already been paid in cash or collateral.

De La Cruz, 37, was finishing a 30-month prison sentence for threatening to assault and murder federal agents. He was flown March 9 to detention in Bayview from a federal penitentiary in Atlanta, according to court documents.

Authorities said Thursday that De La Cruz has been re-arrested, this time on bribery charges.

Those arrested in Brownsville were identified as Brownsville men Julio Torres, 39, Carlos Melo, 38, and Jose C. Venegas, 36; Mexican nationals Adalberto Nunez Venegas, 39, and Juan Trejo Venegas, 33; and Harlingen man Gaspar Martinez Montes, 41, a legal permanent resident.



RESTAURANT SCENE

Authorities would not confirm that the arrest of the six men in Brownsville was connected to Wednesday’s show of force at the Wings-Pizza-N-Things at 4365 N. Expressway.

Several eyewitnesses at the restaurant said ICE agents pulled up and apprehended a group of men sitting in the patio area.

Some of the agents had rifles and others carried handguns, said a witness who requested anonymity for security reasons. The incident happened shortly after 8:30 p.m.

ICE confirmed that an “enforcement action” had occurred but declined to give details.

“Special agents from U.S. Immigration and Customs Enforcement’s Homeland Security Investigations conducted an enforcement action in Brownsville on Wednesday,” an ICE spokesman said in a statement, adding that the officers exercised “appropriate caution to prepare for unexpected events.”

The manager of the restaurant couldn’t be reached Thursday for comment.

One witness said he was sitting inside, looking out a window, when he saw the agents arrive.

“They came out of nowhere. They were in and out,” he said.

The federal agents ran up to a group of men sitting at a table and took them into custody, the witness said.

A woman in the restaurant started running back and forth and screaming, the witness said. At first he thought one of the men who was apprehended was related to her, but later she said she was concerned about her grandson who was next door at the Dollar Tree.



‘GUYS WITH GUNS’

Another witness was eating dinner with his wife and child at Tacos Campeon, adjacent to Wings-Pizza-N-Things.

“I just saw some truck pull up and a bunch of guys run out with guns.… At first we didn’t know who it was, so we kind of huddled in the restaurant,” said the witness, who asked not to be identified for security reasons.

Fearing that a shootout might occur, he and other patrons in the restaurant headed toward the back of the dining room. Another family hid behind the bar, he said.

“I thought something was going to happen,” he said.“I thought they were going to start shooting or something. We really didn’t know they were actual police. They were in unmarked vehicles.”

It was not until a few minutes later he noticed the agents wore jackets with “ICE” on the back.

FEDERAL STING

Magidson, the U.S. attorney, said the bribery case began last May when Julio Torres of Brownsville began negotiations with an ICE undercover agent. Torres, he said, was trying to bribe officials in order to facilitate the transfer of De La Cruz from Atlanta to a Texas facility, and also to plan for his release to “elements of the Gulf Cartel instead of Mexican authorities.”

The U.S. attorney’s office said De La Cruz believed the Mexican government had additional criminal charges against him. He also feared he would be taken to another Mexico location, other than Tamaulipas, and could be abducted by rival drug cartels, authorities said.

In Thursday’s press statement, authorities describe a long investigation in the bribery case.

“On June 28, 2011, the (undercover) agent met with Torres who introduced Mexican national Adalberto Nunez Venegas, 39, as the person sent by De La Cruz to oversee all future negotiations and payments,” the statement says.

“Over the next several months and leading up to the filing of the criminal complaint (on Thursday), Torres and Nunez made an additional eight cash payments totaling $542,090. In addition, six real estate properties had been signed over to the agent to provide collateral for the final payment of $460,000,” it said.

“De La Cruz had also allegedly told the agent that he wanted to see a copy of his immigration detainer as further proof he would be transferred back to Texas prior to removal to Mexico,” the statement says.



FINAL MEETINGS

In January, the same agent met with De La Cruz to go over plans for his transfer to Texas, according to the press release from the U.S. attorney. Another meeting was held just a few days ago with the agent, Nunez, Torres and De La Cruz, who is still detained.

The release said a final meeting was held Wednesday and involved Torres, Melo, Nunez Venegas, Martinez Montes, Trejo Venegas and Jose Venegas — a meeting to discuss final details, including who would drive and ride in the vehicles that would transfer De La Cruz to Mexico.

The six men arrested in Brownsville have appearances scheduled before U.S. Magistrate Ronald Morgan, some today and some next week.

ICE-Homeland Security Investigations, the FBI and Brownsville police are investigating the case."

I just stumbled upon a quote from ICE spokeman Vincent Picard reiterating the party line that the Obama administration "has adopted commonsense policies” by focusing enforcement efforts on deporting individuals with convictions for violent crimes.

Really?

TRAC Immigration (and anyone else with a pulse) begs to differ.

TRAC analyzed available records obtained through a Freedom of Information Act (FOIA) request covering deportation (generic) proceedings filed in Immigration Courts.

This is what they found:

During FY 2011 ICE initiated deportation proceedings against 188,770 individuals who were charged only with violating immigration rules. This amounted to 83.4 percent of the total cases. The proportion charged only with violating immigration rules was up slightly over levels in FY 2010 when 81.9 percent were so charged.

TRAC also found that the number of removal proceedings instituted against individuals with criminal grounds of removal has been steadily declining throughout the past year:

15.8 percent were charged with engaging in criminal activity during the first quarter period (October - December 2010);
15.1 percent during the second quarter (January - March 2011);
14.9 percent during the third quarter (April - June 2011); and
13.8 percent during the fourth quarter (July - September 2011).
The average rate across the four quarters for FY 2011 was 14.9 percent."
