Bali bombers claim firing squad is torture

Lawyers for Bali bombers, Amrozi, Mukhlas and Imam Samudra have filed a court challenge arguing that shooting their clients would amount to torture and is therefore unconstitutional.

Legally the application should have no effect on preparations for the bombers' executions, but the pressure to delay may prove too much for the Indonesian Government.

JAKARTA: Indonesia's Constitutional Court on Thursday began hearing a plea by three Islamic militants, known as the Bali bombers, who are challenging the method of capital punishment in a bid to delay their execution.

Lawyers for the three men -- Imam Samudra, Amrozi and Mukhlas, also known as Ali Gufron -- who are on death row for the 2002 Bali bombings which killed 202 people, lodged a legal challenge earlier this month, saying that Indonesia's method of executing convicts by firing squad was inhumane.

"The appellants, as Indonesian citizens, have constitutional rights, which are not to be tortured," Wirawan Adnan, one of the lawyers representing the bombers, told the court.

The lawyers also asked for the executions to be postponed until the court has reached a verdict.

Attorney General Hendarman Supandji said in July that the execution could happen before the start of Muslim fasting month in early September after the men had exhausted all their legal options.

Aug. 17 (Bloomberg)-- Indonesia said an appeal against firing squads by three terrorists sentenced to die for the 2002 Bali bombings won't delay their execution.

Amrozi, Ali Gufron and Imam Samudra earlier this month asked Indonesia's Constitutional Court to ban the government from using firing squads, in an attempt to delay their execution. Death by firing squad is a form of torture, which is banned by Indonesian law, because death may not be immediate, argued Wirawan Adnan, the lawyer who filed the petition on behalf of the three.

``According to the rules, the review request to the court doesn't delay the executions,'' Hendarman Supandji, Indonesia's attorney general, told reporters in Jakarta today.``Once all the formal requirements have been completed, the execution will be done.''

The three men were convicted for their roles in the blasts that killed 202 people, including 88 Australians, on the resort island. The government may execute the three before the Muslim fasting month of Ramadan begins, Supandji said. Ramadan is expected to start in September.

The three lost their final appeal last month, Agence France- Presse reported on July 17. The terrorists prefer decapitation, Adnan said on Aug. 8.
