Court Overturns 1985 Berkeley Killings Conviction

A federal judge in San Francisco has overturned the conviction and death penalty of a man who was convicted of murdering two followers of the Grateful Dead band at a homeless encampment in Berkeley in 1985.

This is strictly a lawyer out for a pay check. The judge should be disbarred for incompetence.

I read the opinion of the court (also previous decisions in the case)and the decision is based on a whole lots of guesswork that has been repeatedly rejected in the past. It reads more like the "swan song" of a 72 year old judge who wants another "15 minutes of fame' before she retires.

The appeal itself by the lawyers sounds like they know they know they are going to shortly lose their gravy train of funding because he will shortly die because of his ill health.

Sounds like they are kicking him out to save $ on his medical and care bills. If he's had dementia and strokes, he can hardly have a life on the outside, can he?
