I think this guy is misinterpreting the saying: "After breaking my opponent Demetrius I did not kill him immediately," reads the epitaph of a fighter named Diodorus. "Fate and the cunning treachery of the summa rudis [referee] killed me." I don't think he did not kill him immediately because a friggen' Ref stepped in, I mean come on, this was the Roman Colosseum, around 100 B.C. I think it was his decision.

Maybe blaming the emperor was what really got him killed and the engravers of the epitaph feared the same fate if they would have written what really happened.
