If I were Jon, I wouldn't settle - I'd want my day in court just to make a point and casty off any shadows of doubt over my creditability. He can certainly afford it.

When I won, I'd counter sue for my attorney's fees.

If I actually collected, I'd dontate it to charity.

That way Jon would accomplish 3 things - Put the plagiarism rumors to rest, stimulate the economy by paying his lawyer, help those less fortunate.

Here's another perspective. Really good article and gives good insight. This guy was attempting to work w/BoJo since 2/08 and he wrote them a very nice letter (that letter there too). I still don't think the songs are similar, but there are similarities in other ways (see article). And it tells me why BoJo's ILTTown contest never came to fruitation.

I find this all a bit confusing!! So if say, they heard the song and it gave them an idea for example, they can be sued for that even though what they have written is different in most ways? I could understand if the songs were similar but there not. I imagine all musicians get their inspiration from many sources but if in the end it's completely different I can't understand how you can be sued?

My understanding is you can sue anyone. Whether it has merit in a court of law is another issue.

The problem becomes not so much if the songs are similar, but are the ideas and what they represent similar...that's why these copyright laws are so very important to songwriters...Jon, Richie, and Billy included.

I think that sometimes they are and sometimes they aren't hard to prove. Many songwriters in this country are sued successfully by other songwriters because they are able to prove that the songs and their intent are very similar...doesn't have to be exact...I agree with viva when she says that the contest was bagged...looks like by that letter that the guy wrote, they knew that it was coming. Actually the BJ song has nothing to do with baseball when they wrote it, MLB just purchased the rights to use it (or however that works) and just like the AFL is using We Got it Goin on as a theme song, to my knowledge without the AFL in mind. The guys didnt set out to write a baseball song, if anything it would probably be a football song. I love this town is actually written about Nashville, Jon and Richie have both said that and there's no baseball team there. Those guys (Charlotte City whoever) need to get real, they'll probably lose what little money they've made on legal fees. Won't that be a riot, going in for 400 Billion coming out bankrupt.

I didn't say the song had anything to do with baseball...and I do know that it had to do with Nashville, they talk about that all of the time...Billy Falcon lives in Nashville...it will be up to a judge or arbitrator to decide what is what...and I don't think that Jon or Richie or Billy for that matter would think it was a riot if the guy ends up bankrupt...songwriters, no matter how successful, are sued like this all of the time...this just happens to be an astronomical sum, but that has more to do with the deep pockets of the MLB than anything else.

I don't think the guys would think it was funny I was thinking of the irony of them thinking they were getting more money then they new what to do with an ended up being laughed outta court and outta money because of legal fees.

If you read this stuff, it'll answer your questions. The high amt of $ is outrageous, but it can make things embarrassing for BoJo.

Steele filed copyright for the song back in 2006. It was submitted to MLB w/copyright a few years ago. His song was used in 2004 playoffs. He feels the song was modified by BoJo, MLB/TBS. The song has similar technicalities. He's questioning if MLB/TBS had BJ do something similar for their baseball promos.

So then Steele writes this letter to BoJo back in 2/08 and I guess was ignored. He was trying to avoid bad press. So now he's fighting and he tells a Boston newspaper, "I know I'm the little fish & they're the big fish, but they fckd w/the wrong piranha." And there's a Boston firm that's interested in taking the case for Steele. And, as we can all see, the press is all over the place on this issue.
