How does the prosecutor for the district attorney's office know that they had the actual hard drive or computer of Smiths?}} as it says in this article, they are going to try and get the email admitted in from Smith's computer. The district attorney in Calif. only saw Smith's computer after it was in the hands of the people who stole it and passed it around. If the Judge does allow the email in and considers Anna and Bonnie as uncharged conspirators, then the defendants lawyers can show how tainted this evidence is, which will open the doors as to why the extreme charges on Stern came to be in the first place. The district attorney's office probably thought they could scare the doctors and Stern by the extreme amount of charges, hoping they would plead down and this would never go to trial. Jerry Brown would have his big two or three times on television and speak to the media about it and then the case would be pled out and gone. Now it looks like the prosecution does not know how to proceed since the defendants are standing firm and saying to the state, prove we did anything against the law! The witnesses like Moe and others will be immediately discredited because they received money for their salacious stories. The expert medical professionals will speak from both sides and usually the defendant's can pay better for the stronger experts. There is still a chance the Judge will drop some of the extreme charges that cannot possibly be proved in court. Judged: 2 1 1 Here is what was on EOnline: It's kind of a moot point, but apparently the law is the law. Prosecutors said Friday that Anna Nicole Smith is considered a coconspirator in an alleged scheme to get her hands on prescription drugs, which is what former partner Howard K. Stern and two of her doctors are going to trial over next week. Interesting strategy, don't you think? Because Smith was the one who demanded prescriptions for opiates and sedatives, she was engaged in illegal activity just like the defendants were, Deputy District Attorney Renee Rose said in court today. Even Los Angeles Superior Court Judge Robert Perry expressed surprise at this approach to the case. Stern, and physicians Khristine Eroshevich and Sandeep Kapoor are each facing a maximum of five years in prison for multiple felony counts of illegally prescribing and obtaining drugs for an addict. They have pleaded not guilty to all charges, which include 11 for Stern and six apiece for the doctors. And in what sounds like a boon to the defense, Perry excluded all evidence that might connect Stern, Eroshevich or Kapoor to Smith's death in February 2007 from an accidental prescription-drug overdose because the trio are not charged in her death. It's doubtful that they could get a fair trial if the jury is focused on Smith's death, rather than how she obtained the meds, which is what is in question here, the judge said. Also barred was a TV interview from 1996 showing Smith leaving the Betty Ford Center after being treated for alcohol and drug addiction. "For you to say this lady was loaded on drugs for 10 years before these people came along—I don't know how this helps your case," Perry told Rose. More recent footage depicting Smith acting loopy, such as her slurry appearance at the 2004 American Music Awards, was allowed. The judge wants more documentation from the prosecution, however, on why he should allow photos of Smith and Eroshevich naked in a hot tub together to be admitted into evidence. The prosecution maintains that the pictures go toward proving that there was a breakdown in the doctor-patient relationship which could have been abused further. "None of the jurors have gotten naked and got into the bathtub with their doctors," Perry said in response to an objection from Eroshevich's attorney, who called the pics "salacious and subject to misinterpretation." Jury selection continues Monday and opening statements are scheduled to begin Wednesday. The trial is expected to last roughly three months. Deutsch, the language chosen by Renee R. is interesting,“obvious she was part of the conspiracy because she wanted this medication”,“There’s no reason for a doctor to overprescribe if she is not asking for it.” If there was no reason to over prescribe unless Anna was asking for it, thus charging Anna as an alleged conspirator like the doctors, this must be the ONLY way to try and get some of these charges to stick. I think the prosecution and the defense lawyers have certain strategies, when the judge has ruled on what will be permissible in court, that changes the strategy on how each side will proceed. I think that is what happened here, and due to Anna’s physical state of having a second child after 20 years from the first pregnancy, then the horrible devastation of losing that child who was very close to her and compiling many other emotional circumstances onto of those factors.(Like Opri going public and pushing to get the baby) I think the jury will make their decision under the guidelines of law they are given, but I do NOT believe they will find guilty on the few charges that the judge ends up leaving. There still is time for Perry to drop some and I am positive that this trial will not be even half of three months if there are not delay after delay in getting the professional experts on the stand. In other words, if everyday they can have it full of testimony and no delays, they will not keep and pay jurors for three months on a weak case. Calif. does not have the money for that and there are other pressing issues. There are many CHARGES for Stern, a few for the doctors, but I see the only charges sticking is on Dr E, in over prescribing that is only because the pharmacies have collaborated on stating her list was too much. I see her either getting a suspension of her license or having her script writing privileges taken away for a few years. I do not see jail time for anyone at all, ecept maybe something like a one year sentence for Dr. E who would be out in 3 mos. Of course this is just going by what I know, as nobody knows yet how effective the medical experts will be on the stand and if the jury is not split, 6 understanding and 6 not, well it could be a different outcome then. Calif. juries are not like jurors in elswhere, I do not think any other state would have let OJ walk, or Robert Blake off. It will be interesting to see, I do bet every juror will not want to be more than three weeks, this is NOT a death case, the three month statement will never come to be, that I am almost positive about. |

Judged: 2 2 2 On this part, "enabling someone to death" That is exactly what the jurors will think, would be my guess. Dr E. not being a doctor like Kapoor, well she did prescribe too much at one time is what I think most of the jurors will find. Of course these are just my thoughts, who knows. I am trying to look at it as just hearing the experts talk and not all of the other he said, she said. I do not think it is wise to put up the little girl, maybe a q and a on video but not to frighten her on the stand with all the people there. |

To me it was playing around, I really do not think Stern would have said anything about a mushroom trip if she was really as high as some people have said. She was acting when she answered back, what do you mean? Stern is not a svengali like O’Quinn said to the public, I do not think he would ever conspire to harm her. The doctors either, it will be extremely hard to prove conspiracy to harm and that is why many of those charges will not stand. That is how I see it, I know others say differently, but it is not based on any facts. Just based on the elaborated stories from people who were not there or who stretched the facts for their own agenda. |

Judged: 2 2 2 Hello Febbie, you are correct that it was taken and imaged without the consent of Anna's representatives. Some have argued, nobody had been appointed as executor yet. That does not mean to me it makes the crime of taking someone’s property and copying then distributing it to others just go away or not matter later. It also does not mean just because there are no charges yet that there will not be. The facts still have to come out in the civil trial in SC. That case against the theft was filed before statue of limitations was up, therefore any determinations of illegal actions that come from this case (even after 3 or 4 years) can still be charged by the District Attorneys in the states of the people who were found in the civil case to have done illegal acts. I think this way because even though the crime was first committed out of the US, the stolen goods were brought to SC, TX, and then FL. It is a US matter now, and if people profited off of the items by selling videos and such they will have to make restitution. Going back to your original question, I am not sure of how many computers were Annas. A guess would be one laptop. Not a tower computer because she most likely had something portable due to her prior lifestyle of traveling. “Was the estate served a subpoena?” My thought is no, I think we all would have heard about a subpoena being served, UNLESS there was a subpoena signed by a judge and served to the thieves that had the computer. Remember the meeting with the Calif. District Attorney, Susan B., Ford, and people like Don C. from Texas. If that is the case, then the subpoena to get the computer is not through proper channels by legal standards as the people who had stole Anna’s computer had no right to do anything with it. I honestly believe that this Calif. case is smoke and mirrors, they have made it sound bigger by all of the charges than it is or what the Cailf. DA can be able to prove in the end. That is what I truly believe. |

Judged: 3 2 2 It's in one of the warrants that was unsealed that it was an agency to agency transfer in March or April 07. The Seminoles still had the computer that Perper "key word searched". the Seminoles gave the computer(s) to the CA DOJ. |

Judged: 2 2 2 Oh, so it was most likely Anna's personal laptop that she traveled with to the Hard Rock in Florida. I for some reason do not remember following that part as close. Then the SC people stole the home computer from Horizons. I thought it was said Moe took the memory chip from Anna's camera or was it the whole camera from the Hard Rock too. So many items stolen after she died and scoured through, just disgusting to me. |

Judged: 2 2 2 I think that Larry said anything he could to get the door to open up for a DNA test. I believe that Opri, Cosby and others said many things against Stern they could not prove and they said the things they did for their own reasons. Some were valid, to me most reasons were not. Some of the things stated stuck, after seeing no proof and after Wood and Stern went on LKL, many of the talk shows refused to give a free for all platform for the side that was trying to make Stern out to be a monster. Those people who accused him of things like not letting Anna talk to Arthur were not there and it is conjecture that went wild. It amazes me the hate some have for this guy when the people who have accused him over and over were not there. I do not think that Larry went in with Stern like the Texas side states, I think once the DNA was proven Stern was no longer a threat but Arthur was in regards to his daughter. Larry dumped Opri once he saw how involved with Cosby and Texas she was has always been my thought. Once her strong influence and crazy media whoring was eliminated, there were no more crazy statements by Larry. I personally do not recall Larry calling Stern a svengali, I might see him stating in the heat of the moment something like, PEOPLE SAY STERN ACTED LIKE A SVENGALI, but NOT those types of words or accusations straight from Larry. I would have to see that in a video of Larry truly saying that for me to really believe that one. I do not give much weight to what is printed anymore, vetting a story went out the window years ago. Articles are full of what each side says, it does not make either side the truth unless a person was there and saw it with their own eyes and in a unbiased context of the activities. |

Judged: 1 1 1 As you have not followed this case that closely, you probably missed the original broadcast back in Sept or Oct of '07. It wasn't long after Daniel's death and I'm sure that if anyone needed that particular broadcast as evidence of anything, they could get it. I remember the interveiw like it was yesterday. You see, people kept telling me to call and watch whenever LB was on TV. I really didn't think much of it, I knew stern and ANS had a weird relationship so I was not surprised. You probably just got your birkhead's mixed up with your o'quinn's. No need to thank me. |

If you watch the video, I believe that she is clearly impaired due to her eyes seemed at times either darting or rolling to the back of her head for a quick second to me at least. I just don't think that was an act IMO. But, this vidoe is not going to be allowed into evidence so I've read.
