"Prosecutors gave notice Friday that they are moving forward with their appeal of a judge's decision to throw out nearly all of the charges on which Anna Nicole Smith's longtime companion and a psychiatrist were convicted last year. In papers filed in Los Angeles Superior Court, Deputy District Attorney Irene Wakabayashi wrote that the prosecution is taking its case to California's 2nd District Court of Appeal. The filing comes almost two months after Los Angeles Superior Court Judge Robert J. Perry tossed out the only two charges on which Howard K. The prosecution made so many mistakes and he knew it.

On page 6 of the transcript Mr. Carney for the People says, "At this time we haven't made a final determination." Earlier, Judge Perry, asked if they were going to retry the conspiracy cases on the object crime. WHY would they not want to retry the Case?

It is my understanding that it might take a few months before the appeal is placed on the calendar, assigned to a division and a panel of justices. I don't believe that the Court of Appeals is going to refuse to review the case, but, in this saga, everything is possible. IYNWIM.
