Judged: 5 5 4 Looks like 4 of the judges DID VOTE IN FAVOR and the ANS estate just barely lost to what many of the HATERS said was a completely stupid filing to begin with---- The ONLY PEOPLE who really lost out was the HATER's heroes from TX who spent MILLIONS trying to get control of that case IMOO! FOOLS! -- GOOD! Now MAYBE LB and DL along with HKS can be LEFT ALONE!-- |

Judged: 4 4 4 They determined the Bankruptcy court was not constitutionally able to enter a final judgment in the case as it would violate Article III of the constitution. So the Probate Court was the first final decision by and Article III court. JMO |

The high court ruled today that a bankruptcy court’s decision to give the now-deceased Playmate $475 million from the estate of oil tycoon J. Howard Marshall was decided incorrectly. Smith and Marshall were wed in 1994, and he died the next year. His will left his estate to his son, E. Pierce Marshall, and nothing to Smith. A California bankruptcy court awarded Smith part of the estate, but the 9th U.S. Circuit Court of Appeal said that a bankruptcy court could not make a decision on an issue outside of bankruptcy law. Judged: 4 4 4 It was a clear majority in the case. Also I don't believe that the people in TX you are referring to were after the Marshall money. The one person both you and I know for sure who did file a claim to collect on the Marshall money if it happened was Howard K. Stern. I do hope that now DL can fade out of the limelight into a quite normal out of the spotlight childhood. JMO |

HKS FILED for DL! --you do know that though, don't you-- yes, it would have been nice for DL to get some and the appelate lawyers (even Stern) for his time to get 3% of something, but that is not the case--- (TX would have taken a percentage in the DOUBLE DIGITS!) This legal battle has been going on since well before Smith's 2007 death. As NPR's Nina Totenberg reported in 2006, "the case ... is better than a Harlequin romance novel. It's part Knots Landing, and part Shakespearean filial betrayal. The plot centers on the estate of the late J. Howard Marshall. An estate valued at $1.6 billion. The protagonists are, shall we say, not without flaws." Smith, who was 27 when her 90-year-old husband died in 1995. They had been married about a year. She was a former Playboy Playmate, model and aspiring actress. After Marshall's death, the family began to battle. His will had left his money to a son, and none to Smith. Chief Justice John Roberts, who wrote the majority opinion (the vote was 5-4), drew on the unusually flamboyant nature of the case: ------- "This 'suit has, in course of time, become so complicated, that ... no two ... lawyers can talk about it for five minutes, without coming to a total disagreement as to all the premises. Innumerable children have been born into the cause: innumerable young people have married into it;' and, sadly, the original parties 'have died out of it.' A 'long procession of [judges] has come in and gone out' duringthat time, and still the suit 'drags its weary length before the Court.' "Those words were not written about this case, see C. Dickens, Bleak House,... but they could have been." ------- Today, the court basically agreed with a 9th U.S. Circuit Court of Appeal's ruling that said a bankruptcy court that had awarded Smith's estate $475 million form the Marshall's estate did not have the authority to do that. |

Judged: 4 4 3 They agreed to hear the case to make a final decision and to clarify. They didn't totally agree with everything the 9th circuit decided or based their decision on, they did agree with the basic outcome though. Not all cases the Supreme Court agrees do they plan to reverse. In the six decisions released today, three were affirmed. The $475 million was awarded by the Bankruptcy court, that was overturned by the District court which awarded the $88 million, which was then overturned by the 9th circuit twice. The first time the Supreme Court reversed the 9th circuit. This second time they have basically affirmed. Therefore there will be no money. JMO |
