I am really looking forward to hearing the arguments for/against Health Care Reform starting today; the republicans idea of an individual mandate is the so called controversial part - that the very hypercritical people who were for it, turned against it when the President added it – that most likely will be upheld as constitutional.

ONE WONDERS that people do not understand facts and truth , by talking about RomneyCare.

There is no RomneyCare today , as Romney is not the president givng to the public of any health care, but Obama.

But if they were to talk about this ObamaCare (National Health Care), by drawing the relationship to RomneyCare, it has caused people misunderstanding and not knowing the
true facts.

If Romney ever came up with that health care in Mass., it was just in Mass-a State Health Care.

So if Romney would be the president, it would not be a NationalCare---it would be up to state choices, as it means there would be no national health care like Obama doing the national health care now. It does not mean what was in Mass. would be applying natonalized.

People need to clear their minds by knowing the difference between RomneyCare (Not a national care if any---but optional, with no dictatorship, for free choices ) and ObamaCare (a dictatorship of national care), as they are not the same.

I'm amazed at the sheer ignorance of so many people regarding this law. No, MakesSense, it has nothing to do with overturning Roe v. Wade and your understanding of the Citizens United is just as lacking. And the unconstitutional part, the part that will be most telling, is using the Commerce Clause to empower the government to REQUIRE everyone buy a product or pay a fine. If that passes then there is no reason the government couldn't pass a law that everyone drive an electric car or pay a fine, or that everyone build and use their own private windmill to produce electric for their home, or pay a fine, or that everyone must, for the good of the country, purchase and eat at least one serving of green beans or fish or pork a week. It would allow the government, any government, to dictate exactly how and when we purchase anything that the government deems a benefit to the country. Got it now? All you progressives so in favor of national health, are you also ready to follow the dictates of a REPUBLICAN president and congress? Just remember, Obama is NOT going to be president forever.

If the Court should rule the mandate unconstitutional, would that alleviate the Income Tax Mandate, or the Mandate to register for selective services one you turn 18?

The entire Affordable Care Act is a contrived proposal from the Republicans, First Richard Nixon proposed the same law as an alternative to Universal Health Care proposed by the Democrats in 1973, the Mandate was attached when Bob Dole proposed the same piece of legislation during his run for President.

The Republicans opposed the legislation only because Obama folded from the proposal for Universal Health and, Obama would not support the democrats proposal for a Public Option. This is in fact a Republican plan and not the preferred reform the democrats desired.

It was for that reason the democratic base stayed home during the 2010 Midterms which saw the Tea Party and GOP win the Majority in the House of Representatives. Romney did not invent this Health Care proposal, he just borrowed what was already written by the Republicans and pushed it through.

If the Mandate is unconstitutional, would the Mandate on Hospitals with Emergency Rooms and Trauma Centers to treat to stability anyone regardless of their ability to pay also be Unconstitutional?

Why would it not be given those institutions are private facilities and the money forwarded by the Federal Government does not sufficiently pay for treating the uninsured.

The SC will probably decide that the Inbred Genius healthcare plan is better.....I buy mine, you buy yours....end of plan.

Selective Service and the Income Tax have nothing to do with interstate commerce. I suggest you google or whatever search engine you use Commerce Clause and read it. SS and Income Tax and emergency rooms, do not require the PURCHASE of any product, uniformly, by all or pay a fine. Really, if all you do is get your information form the MSM it's no wonder you all are so woefully ignorant of the reality of this case. According to the writer, compulsory and contract as in compelling people to make an agreement or contract to purchase insurance is an oxymoron. A contract implies mutual consent without coercion of any type,such az a tax, fine or fee. One may CALL the penalty for non-compliance whatever he wishes but it still meets the definition of coercion.

Of course there are many angles to the argument and the outcome will be impacted by the ideology of the individual justices. Some will examine the issue according to careful scrutiny of Constitutional guidelines. Others will look to some perception of "the greater good." Social Security and Medicare are disability insurance coverage that are mandatory in America.

You can classify either as you wish, but they both absolutely are Insurance coverage which are also available on the open market.

Granted, Selective Services, and Income Taxes are extreme examples, but failing to participate in either has consequences, sometimes rather extreme.
