BTW: Over 100,000 Mainers signed the petition to extend marriage to same-sex couples. If you haven't heard, Maine had its caucuses last week. I thought this might be a good place to share the letter that I sent to the editor of the local paper today: me wrote: Last week, the Ninth Circuit Court of Appeals agreed that California’s Proposition 8 of 2008 is unconstitutional. Unless a higher court overturns the ruling, California will rejoin the growing roster of states that recognize marriages of same-sex couples. Meanwhile, the New Hampshire legislature is preparing to vote on a bill to revoke marriage equality. According to polls, repealing marriage equality is unpopular in the Granite State. But a powerful group of politicians and allies are intent on just that. Why? Look at the Judiciary Committee’s report. Referencing the civil unions law that preceded marriage equality, Gregory Sorg wrote “Equality of rights thus having been expressly codified, what could have been the purpose of advancing the agenda to formal marriage in 2009 if not to be able to claim society’s approbation of homosexual sex?” More accurately, gay couples sought equal recognition of their commitments, not approval of sex. Representative Sorg’s words indicate a desire to demonstrate disapproval of homosexuals by relegating same-sex couples to a separate status. New Hampshire and California both recognize the fairness and value to society of equivalent rights for same-sex couples and intend to leave those intact. Yet Judge Reinhardt wrote for the Ninth Circuit “Proposition 8 serves no purpose, and has no effect, other than to lessen the status and human dignity of gays and lesbians in California, and officially reclassify their relationships and families as inferior to those of opposite-sex couples.” One single institution called marriage works well for all New Hampshire couples. The committee reported no problems resulting from current law. So repeal is unnecessary. But it is divisive. And protracted litigation will follow, just as litigation followed Proposition 8. The legislature should abandon its unnecessary, unpopular, doomed excursion into divisive politics.

Their Decision can and will be used as precedent. They ruled according to the specifics of the case, and upon the specifics of the case. They carefully worded their Decision as applying to the particulars addressed. Sadly, they acknowledged the admissable sociologic testimony presented in the lower Court, but stated that it was unnecessary to their Decision. In the way that the case was Ruled this is certainly true, but it is a major loss for us inre Suspect Classification before SCOTUS. Still, by excluding those testimonies, they pared away one more possible grounds for Certiorary before SCOTUS, and possible reversal.
