Lawsuit focuses on settlement's disclosure

Kamehameha Schools is suing an unidentified non-Hawaiian student and his mother for disclosing a confidential settlement reached last year in a 2003 lawsuit challenging the schools' admission policy.

"Kamehameha Schools is suing an unidentified non-Hawaiian student and his mother for disclosing a confidential settlement..."

What is the basis for suing them? It was the attorney that disclosed it: "In February former attorney John Goemans revealed that the school paid $7 million to settle the 2003 case..." Sue him IF he agreed not to disclose it--if he didn't, then I don't see much of a case.

Hmm seems Hawaii is in the same Supreme Court appelate district that upholds "Truth at Trial" for all civil action... was it true? then as a psuedo-government entity the district has no right to conceal a monetary settlement. Now lets indict thier lawyers for breaking the law by asking for confidentiality??

Sounds like Goemans wanted the settlement figure known to indulge his ego--"Look how much I helped nail Bishop Estate for". Now he has put his ex client at risk. A real jerk.

Goemans in his public presentations appears to have "lost" it a little and may well have forgotten, momentarily, his promise to be quiet. That's one of the reasons lawyers should be more quiet. If it is worth saying. Say it in print.

Kamehameha Schools is a purely private institution, not s pseudo-government agency, Mark. It funds its educational activities (on campuses and in the community) from the proceeds from its Endowment.

What do you expect from Ha-oles (no life), they are the parasites of society and wish to continue that existence at the expense of others (non-whites)?

Racial segregation was created by the whites, now they are trying to make money off the backs of the very ones they prostituted for profit?

Look at this way, Kamehameha Schools is a private entity, receives no federal funding, yet comprises of whites and other colored races. The admission policy falls in line with other private agencies.

Did you ever apply for educational grants? Well I can tell you that there are restrictions and rather racist criteria on some. Some require an applicant to be Jewish, Black, Hispanic or other nationalities. Yet, they are allowed business in America.

Kamehameha schools was setup to correct the wrongs done by the whites to the Hawaiian people through education.

So, if Kamehameha lawyers have some sense, they would include all other parties that practice selective policies. Now if they are even more aggressive, the lawyers should do a background check on every Justice and see if they received any funding from these so called "racist" institutions for their education? Then have them considered "conflict of interest", and invalid to judge this case.

This case should be thrown out if is identical to the previous lawsuit and the attorneys should be fined and disbarred.

My family has been apart of Hawaii since the Kingdom, and as a non Hawaiian of blood, we have always understood that the KSBE was founded to benefit native Hawaiian children or those with the koko of Ko Hawaii Pae Aina.

It has become very clear over the years that the real goal of so called ambulance chasing attorneys is $$$$$$$$$. Their intentions are based on greed, pure and simple.

The children in this case are not the ones to hold blame. It is their parents and their own greed which takes them to such a dispicable place. They see KSBE more as an opportunity to make a buck and if their children get in it's just an added bonus for them. Even as they skirt the issue of $$$$$$$, their real intention is not the first class education nor is it an issue of discrimination, no matter how much they would like to convince the public of their motives. We all know that they see KSBE as a cash cow and all comes down to how much $$$$$$ they can get. Pure and simple.

There are many private schools in Hawaii that one can choose from. I am an alumni of Punahou and my children are as well. A MAJORITY of locals have no problem with KSBE. But it's that minute elitist non Hawaiian social class who thinks that they are entitled to benefit from the "WILL" of a HAWAIIAN princess who want to re-interpret her wishes to include them.

Leave KSBE alone. And leave the "WILL" of the princess alone. It was her's to do with as she wished and it should be respected.

It's sad how these people have only greed in their lust for money and have lost all self respect. Shame on you!

7 million dollars to settle that case is crazy. How much damage did you incur by not being allowed to attend Kamehameha Schools? Not 7 million dollars worth.

One of the lawyers didn't get his cut thats why he let the cat out of the bag. Its always about the money.

Unfortunately these plaintiff attorneys are doing all the tricks in the book that give Attorneys/Lawyers a bad name.

First, Rosen has his buddies send out a solicitation email in an attempt to get plaintiffs to retain him. Rosen then maintains that he did not ask the person to send out that email and thus he should not be held accountable. Does it matter, no, the damage was done. Rosen got free publicity out of this stunt and has yet to be punished by the Office of Disciplinary Council.

Second, Goemans releases the terms of the settlement agreement. However, he says that he was not the attorney on record and that even if he was that KS would have had to release the information anyway. Such hogwash.

The actions by these two individuals was done to benefit Eric Grant. It allowed potential fake plaintiffs to be solicited in contravention of the rules that govern the practice of law in Hawaii. Further, the actions of Rosen and Goemans induced fake plaintiffs to file a suit with the hopes of getting a BIG PAY DAY,$7 million dollars, thats $7,000,000.

The actions by these LAWYERS was purposeful and systematic. These guys knew what they were doing and took advantage of the system to accomplish their goal of taking more money out of the pockets of a school that educates the children of Hawaii.

It's a sad day to be a lawyer in Hawaii. Lawyers not from Hawaii come to Hawaii to exploit its people all while giving Hawaii lawyers a bad name.

Whenever a wealthly trust like KSBE is awashed with revenue, there'll always be parties (including the IRS) willing to claim a piece of that revenue.

Worst Case Scenario:
KSBE loses its tax exempt status as a result of an unfavorable U.S. Supreme Court ruling. Millions upon millions of KSBE dollars will be transfered to the IRS so Congress can continue to fund its lucrative foreign aid and other creative ventures.

Disclosing the settlement only encourages more lawsuits, like the one that was most recently filed. Goemans should have to pay off any plaintiffs who file against Kamehameha Schools because of his disclosure. That's fair.

By suing the plaintiffs, they have the money. In turn the plaintiffs will now sue to attorneys for the breach of contract.
