Two courts have decided it is NOT her right to do what she did.
Please read up on the United States legal system and understand the difference between injuntive relief and a trial.

By the way if you actually read the original Kravitz decision he clearly states that he was not ruling on the action nor the discipline and states that this will ultimatly be decided by higher courts and a full trial.

IT QUACKS LIKE A DOUCHE BAG
BURLINGTON, CT – Is the Karissa Niehoff letter, sent to Midwestern educator Mike Morris, the real deal?
http://cooljustice.blogspot.com/2008/06/it-qu...
Looks authentic, but as you know, better to verify it before dragging it into court.

It appears that the e-mail was written on Saturday morning, so that would not have originated from the school computer. Next question:
If Ms. Niehoff did indeed write this e-mail and used her home computer, should the taxpayers have to pay to defend her for something she did while off school grounds?

This young lady, Avery Doninger, abused the system. She showed a total lack of breeding, upbringing and culture in doing what she did. She should be punished, so Avery, quit crying, the very system you tried to abuse has ruled, learn from it and move on.
We are LUCKY to have Avery in our world! She would not be here without her mother! I am so glad that my sister decided to "breed" and that the "upbringing" and "culture" Avery has is ONLY due to her MOTHER (only mom). My niece is not crying......laughing I hope! Chew on this CHU, did you "breed"?.........if so, heartfelt wishes for any child you have!

Typical today's teenager. If she had been taught some respect at home, this wouldn't have happened. In my day a trip to the woodshed would have solved the problem.

if we are to be so critical of students standing up for their precieved rights, shouldn't we get as upset with the bullshit being leveled at us by the presidential primary candidates.
in the truman and eisenhower eras, speech and behavior as shown by our senate and congressional leaders would have been dealt with as treason.
get over this brat and her mother-deal with some real problems
"brat"? I can tell you this.....her mother is over-come with PRIDE over her BRAT! I know that you are doing the best that you can with regards to "THINKING" so I will overlook your level of education (rather lack of) and respectfully ask you to GET THE FACTS prior to shooting your silly mouth off!

Lol! To protect their sensitive little ears to name calling??? Are you for real?? Protect???
Saying you're going to bring a gun to school and shoot everyone is a physical threat. Being called a "douchebag" (sic) is just a harmless word.
Just like if in an newspaper editorial a writer called an official a corrupt weasel, he'd be in the clear. But if he said in the piece he was going to send his reporter to a meeting and shoot the official, he'd be in trouble. Because that's a threat. Get it? Probably not.
It's because of people exactly like you why we're seeing out Constitutional rights eroded (And of course idiot school administrators who don't have a grammar school level understanding of civics yet are being paid six figures to make sure the kids learn their lessons).
Maybe they should go to North Korea and head a school there. I'm sure they'd be glad to have them. They'd be much more happy.
Respect has to be earned, and even the kids know these administrators are jokes.
Better.....too cool! THX!

Your definition of the word "breeding" differs from that of the original poster that you are mad about. See definition below.
The original poster is talking about #2 and #3. You are talking about #1.

Breeding Definition breed·ing (-iŋ)

noun

1. the producing of young
2. the rearing of young; upbringing, education, or training, esp. in manners or social behavior
3. good upbringing or training tolerance is a sign of breeding

Please, Aunt Nanci, you're evidencing the same lack of culture and dignity that got your niece in trouble in the first place.

It matters not that you are proud of your sister and your niece, and that you don't find offense in your niece's behavior; what matters is how she grows and progresses from this point.

If she is unable to move ahead in life, and should she and your sister continue with resentment and anger, then they haven't learned anything and they will forever be stuck believing this is just a "free speech" morass; when in truth it is more an issue dealing with behavior, dignity, maturity, and upbringing.

The examples set for your niece have helped to formulate the examples she, in turn, have set.

Let's assume for a momment that you are correct.

Who gets to determine what is the norm and what is not?

In the Lewis Mills handbook it says students can be disciplined for "smoking or drinking" off campus. That is not a judgement call it is state law.

In this case there is no state statue for offensive language.

If you notice even though this forum does censure certain words "douchebag" is not one of them.

( but if I type the word Bullshit it will be edited)

So who is the arbiter of these issues?

The administrators, the BOE, the parents, you?

Last time I looked this was a public high school not a finishing school.

Courses in Sciences and Humanities are taught in school not morals, and proper discipline thats the parents domain.

Another class act from the same family - maybe the word is inbred not breed. Apple and the tree and sometimes you just get applesauce.

Do you really think this family should be commnenting on others "shooting your silly mouth off" - Auntie, spread your advice to those closer to you, namely Miss Avery! What is the expression - practice what you preach.

Nick,

Regrettably, but truthfully, I must say that your posts have now gotten to the point where they no longer have any meaning.

In your earlier posts, you were just guilty of wandering all over the place and bringing up irrelevant subjects that had not even a remote connection to the matter at hand -- which is the inappropriate comments made on the Internet site viewed by the girl's high school peers.

Now, based on your continued postings involving irrelevant and wandering subjects, I'm concerned that you are out there all alone -- way, way out there -- searching for extraterrestrial civilization on Mars, or sun spots on Enceladus.

Earth to Nick, come in please...Earth to Nick, come in please.

This topic has been used and abused too many times. Let's refocus on another incident that happened at Mills today. A student threatened to hurt other kids during final exams and was removed from the school. Call the office and they knew absolutely nothing and this was from the principal's secretary!

There is a lot of subversive stuff going on at that school with a lot of people thinking that they are mightier than everyone else. Speaking of that, how about the email the principal sent off to a guy in Wisconsin who inquired about Avery's case. She had some pretty negative, offbase comments about a student and was suspended for two days.

Amy has got her fifteen minutes of fame. Imagine what could have been accomplished if everyone had channeled their energy to do something positive rather than comment on this story that is now history until the next chapter is written.
Have a good Summer Amy. Tough adjustments are coming your way when you attend college in the real world.

PRINCIPAL MAY HAVE VIOLATED STUDENTS PRIVACY IN EARLIER E-MAIL

http://www.rep-am.com/news/349278.txt

"Now a new e-mail -- one of about 40 released late Wednesday in response to a request from Avery's mother, Lauren -- shows that Niehoff had made similar remarks to another educator in July 2007.

In an e-mail to a man named Bryan Jones, Niehoff wrote: "The story that has been shared in the media by Avery's attorney, and by her mother, is not accurate, nor does it address the multitude of incidences for which Avery was warned before the posting of (her) blog.... This was not a first-time offense; Avery had not received any consequences prior to this incident.... Avery had been spoken to by teachers and administrators on many previous occasions about this specific type of behavior."

THIS WAS NOT A ONE TIME INCIDENT.

HOW MANY TIMES DID SHE AND OTHERS DO THIS AND HOW MANY OTHER KIDS HAVE THEY DONE IT TO???????
