Court overturns airline Bill of Rights

A federal appeals court Tuesday struck down a state law requiring airlines to give food, water, clean toilets and fresh air to passengers stuck in delayed planes, saying the measure was well-intentioned but stepped on federal authority.

Not that simple. The bill was a blatant violation of the Federal legal provenance in interstate travel. I don't know of a single legal professional who thought it had a prayer of surviving a courtroom challenge on constitutional grounds. The bill could work as a Federal law, but not as a state law.

Today you can fly coast to coast on an airliner for about 1/4 what it would cost you to drive it in your car, including $2.90;whoops $3.30; a gallon for gas, motel stays, food, and wear and tear on your car. And yet the consumer still complains that the airlines are taking advantage of them. Meanwhile, airline employees, on average, are making 18% less today than they were 12 years ago and working harder than ever.Oh,and the 14 days off per month that I have ='s 16 to 17 days on the road;no sleeping in my own bed;no eating dinner with the family; No Christmas with the family until our Fake one on Dec.28th.
17 days gone x 24 hours a day = 408 hours per month. The Empoyees feel you Pain as well and yet most of the time still do an outstanding job.So if you think air travel is a rip-off, then throw your bags into the trunk of your car and drive, and see what that costs you in money and time. Air travelers are getting the deal of the century right now. Airlines don't serve food any more because they have to compete with other airlines, who also don't serve food. What it boils down to is that the consumer has stated very clearly that what they want most is dirt-cheap tickets, not food or good service.Because there are still thousands of the worlds best trained pilots right here in the U.S.A. the public will continue to get the safest flight possible for almost nothing! So you got exactly what you asked for,a fast and SAFEST mode of transportion available; so PLEASE stop complaining. The public did nothing but complain and make jokes about the airline food, anyway - and now you're complaining because it's gone? Fuel prices have skyrocketed in the last 12 years,(20 cents per gallon to 3.05 per gallon) as everyone knows ;oh and a flight from ATL to LAX burns over 4000 gallons of jet fuel on the newest fuel efficient 737's).
You do the math($12,000(4000 x 3.05) divided by 137 people on a full flight =$87.59 each way; just in fuel; not counting the cost of a 50,000,000.00(50 million) dollar airplane; the 1 million dollar gate(Yes the Airport gets it's $$$) and all the professional people it takes to fly them.Yet a ticket from Atlanta to Los Angeles is cheaper today than it was 12 years ago. So what are you all complaining about? That's right, I'm an airline employee. I'm quitting;started my own business 2 years ago; because I can no longer support my family on the meager wages I make in the airlines after being forced to take two enormous pay cuts in the last 3 years.I'm one of the lucky one's.Oh'and when I travel in the future; I will be gratful and thrilled to pay whatever the Fare is. Some day soon, the free lunch will be over for air travelers, and they will have to pay a fair price for a plane ticket. And if you don't like it, then you can drive your gas-guzzling car or take the train or bus every time you travel. And by the way,how many times do you stop on a 3-4 hour car ride to eat or use the restroom? Try to do this before you get on the Airplane!!!When I was a child; My Mama always used to ask before a trip....Well you get the picture. Plan Ahead!!!! Many times the passengers, not the airline employees, who are rude. I know this because I Fly you every day; Please the job is tough enough.I believe that those people that were stranded on Jet Blue have made more than enough noise;hurting every Airline not just JetBlue!Just Don't give them your business next time. ALL Airlines are not created equal!!!Most do C.A.R.E.(Customers Are Reasons to Excel). This will continue to be my Moto for you the Airline customer for 6 more months.

The house had a bill to bring to the floor to a vote on this issue that would have passed easily and become law. But Pelosi refused to send the bill to the floor. Now it is too late because the Court has rejected it. Yhat's the Dems for !! Always looking out for you!!!!!

this is a load of crap. Again I say, its all aout the money.

Airline have been getting laws passed in there favor for years, its big bussiness.

Think they outlawed foor and drink behind the check point for safety? go through the check point and you can buy a soda, that is allowed on the plane. It cost you $3 buy hey, its not price gauging, its not a necessity, neither is water or food. By there thinking you wont be on the plane that long. YOU DONT NEED IT! Ever been stuck in a plane for 30 hours? Try it sometime, you will love the smell.

Federal law my butt. California says pot for medical use is ok, that is contrary to federal law. Yes I know you can still be procecuted in a federal court. That is not the point here. Point is that states do have the right to adjust the laws. They always have been, it is in the Constitution. Read it sometime, you will love it.

And now you know why there is a lot of pork barrel spending on transportation. If it didn't occur, travelers would be paying much higher prices for much less service. McCain is wrong to oppose pork barrel spending on transportation.

Did she refuse to send it to the floor because she knew it couldn't withstand a court challenge? Why waste time voting on something if it won't stand up in court.

It says a lot about the airlines, in that a law mandating basic humane treatment of passengers was deemed necessary in the first place.

Remember, this law was a response to a planeload of passengers being trapped on the ground for half a day without basic necessities.

The airlines are terrible these days. I was dumped off at an airport after the first leg of a 'one-stop' flight. Turns out, because the flight left it's starting point way late, they cancelled the second half of the trip EVEN THOUGH they knew that before we took off. So all us passengers who thought we'd be home in a couple hours were left in a dark and deserted terminal at midnight - ALL night, with no ticket agents, no hotels with available rooms, no place to get a meal, and not even an apology.

I've also been trapped on a parked plane, with no air, in mid summer and stifling hot, not even a drink of water available, for several hours. It wouldn't kill them to deplane when they know damn well the flights not going anywhere. It's just inconvenient (for them!) to do so.

Air travel has turned into an unpleasant experience all the way around. It's a wonder any of them stay in business.

Sitting next to a window on the airplane, looking out over the lands as we fly over, I ask myself, What does God see in all this? What does God see in all those people down there? Why do all these people still hate other people? Why do they all still steel, kill, abuses, one another? etc. Yet, I ask myself, Why do I still judge others without looking at myself first? Why do I feel their hatered and see their greed? Flying is great, gives one a sence of thought, and faith. Up there your stuck in the hands of a pilot and a plane you don't know if, it's safe to fly? or anyhting could happen even if, it isn't the plane nor pilots fault.

Hopefully customers will stand up for their rights. Within the last couple of weeks, I had 3 separate family members who flew internationally. All 3 had a terrible experience.
People can always file complaints at sites like, http://www.iripoff.com and other online consumer sites. Hopefully after everyone hears of horror stories, Airlines will be forced to make changes. Until then, I guess were at the Mercy of these airlines?

Let's all remember this the next time an airline needs money to stay in business. "Well let's just see what you will sign to do for that loan - a binding contract with strict penalties."

I rather drive anyways, my seat is bigger and I have a choice of who is sitting next to me. No 3 hour or longer delays, no cancelations, don't have to worry about fighting for a refund or being bumped. Yeah gas cost is a pain but then again when your taking your family it's cheaper in the long run. Plus I don't have to worry about what I can and can't take with me.

You sound like a disgruntled employee too proud to admit that you got cheated by the big corporation who eff'd you over. That's right. You got eff'd.
The higher one climbs up the corporate ladder the less work they have to do in order to only carry the burden of responsibility of failure, which is controlled by the significantly lesser paid workers. You were a pawn.
