Did the anti smokers back off this article to try to bury it? Sure does seem that way. In part:
I request on behalf of not only myself but all of my fellow Ohioans that you as State Legislators empowered by the people of this State the Tax payers hold those responsible for the attempted illegal transfer of $190,000,000.00 from the State of Ohio’s Treasury. Surely the Ohio Legislature could ask the Ohio Attorney Generals Office to sue for damages by those that took part in violation of R.C. 121.22 as noted by the following Case BOARD OF TRUSTEES OF TOBACCO USE PREVENTION v. BOYCE DECISION http://www.leagle.com/unsecure/page.htm...
As noted in the DECISION the court states that four attorneys took part in the violation of Ohio Law being "After thoroughly reviewing the record, we conclude that the board violated R.C. 121.22 by improperly convening in executive session and by deliberating upon issues not raised in the motion to convene, and that the resolution resulted from those nonpublic deliberations"
As attorneys (four of the board members) are they not supposed to uphold Ohio's law? Why did they allow this illegal act to take place and worse to participate in it?
Truly disgusting is where Ohio Senator Dale Miller one of your own took part in this violation of R.C. 121.22 this my dear legislators is preposterous! Surely as legislators you can tale action against one of your own that participates in violation of Ohio law and we the people of this state demand no less of you. From the passing of a resolution against the actions of Senator Dale Miller to censor of him or worse would indeed be appropriate when one considers the good people of Ohio that could have been assisted through your combined effort's to help those unemployed or losing jobs by your passage of the Economic Stimulus Package and the funding that was delayed by his action.
Not being addressed is the conflict of interest here in this matter. It is beyond belief that those voting for this motion did not have knowledge of the transfers of funds amongst the anti tobacco coalitions they had dealt with. Susan Jagers was by known them and you as well as an Employee of the American Cancer Society a registered lobbyist and a primary director in the Smoke Free Ohio Ballot Initiative.
What is so interesting is that Susan Jagers that made the motion is an employee of the American Cancer Society/ Registered Lobbyist in Ohio and was a primary director of Smoke Free Ohio! So you might say what?
