Did you have a suggestion for the DEA to act otherwise? Should they have kept it legal just to keep it from going to the black market?

We do not live in a police state yet. Why does Ms. Elias make it sound like iit is illegal or bad or otherwise inappropriate for K2 to be continued to be sold? Why does Ms. Elias not have her facts correct? Why does Channel 10 continue to allow poor reporting to be aired or published?

First, it is the Drug Enforcement ADMINISTRATION not Agency! Oh well just a little mistake.

This report is frighteningly parallel to the media's normal reporting on gun control.

The earliest K2 will become illegal to possess or distribute will be December 24, 2010, presuming DEA publishes the final order in the Federal Register on that date. That is control federally and only federally. Prior to that date it is perfectly legal for anyone to possess, manufacture, distribute (meaning SELL) K2! Why should Ms. Elias imply otherwise?

Prosecutor O'Brien's quoted comments indicate that K2 is no longer legal, which is not the case. I wonder if Ms. Elias told the Prosecutor that DEA issued the order to make K2 illegal and then got his reaction which she quoted. DEA only published a Notice of INTENT to place K2 into Schedule One of the Federal Controlled Substances Act. Thus, Ms. Elias may have caused embarrassment to Mr. O'Brien.

Ms. Elias failed to address how this pending action by DEA impacts Ohio. Does Ohio law provide for an instantaneous placement of K2 into Schedule One under Ohio law based upon an emergency scheduling action taken by DEA ? Only then would Ohio state and local police officers and prosecutors be able to take any action. If not, only DEA personnel and Offices of the U.S. Attorney could enforce this emergency scheduling order. Sure would be nice to know how DEA's action actually impacts Ohio!

Reporters should report facts. As written, this article should have appeared only under opinions and editorials to ensure that readers and viewers are not misled! But then why publish something that is factually flawed?

We should concentrate more on eliminating the contaminate in K2 because it's still going to be sold. That is, if the manufacturer/distributor can be identified..Is anyone tracking K-2 related emergencies nationwide?
Simple solution: manufacture it without contaminates in America to provide a controlled- safe alternative to this sprayed herb.

This article is so poorly written, it's "an herb?"
Does anybody read their copy? Does the person reporting the story proof read his/her work? Professionalism isn't required in journalism anymore.

Why do they have the k2 in the stores for months and then decide it should be illegal, why did they ever put it on the market, when I'm sure they tested before now, so after december if your caught with K2 you get a case but it was legal last month go figure.

I am continually amazed at the rhetoric used by the 'Prohibitionists'. There are NO deaths directly attributable to either Marijuana or K-2. Typically, if a person dies, and marijuana was in their system it was trumpeted as a Death from Marijuana.

With all the serious problems facing us today, I don't think marijuana smokers (even phony marijuana) is very high on our list. In fact, with government budgets being what they are, how much will this ruling cost us tax payers to enforce? Per inmate jail costs start at $45.00 per person per day of incarceration. Not to mention court costs. The insanity has to stop somewhere, but with 'reporters' stirring up the uninformed to create a 'story' I have real doubts whether our Publicly Owned Airways are being well served by this drivel.

I'd rather see politicians and those who milk vast profit from our hard work go to jail than nonviolent drug users. What people do in the privacy of their own homes among consenting adults is their own business.

If it is so addictive what are the withdrawal side effects? Oh yeah that is right...it isn't, and there aren't any. I have smoked spice on and off. It is stronger than pot. No one knows what the long term health issues that could come from this will be, but the DEA is full of it. I am so glad I got out of Ohio.
