The death penalty is unconstitutional as a punishment for the rape of a child, a sharply divided Supreme Court ruled Wednesday.

How about the molestation AND MURDER of a child? Do you really think the punishment for the former and the latter should be the same? Wouldn't that inevitably lead to more children being murdered by their abusers? |

1 What about the 80 year old alhzeimer granndpa who doesn't know that he is raping or molesting his granddchild, could you put your alhzeimer grandparent to death? Most children are raped or molested by a family member or close family friend. I agree that it is a hidious crime, but I don't know if I could give the death penalty to my grandpa who had alhzeimers. This is just something to think about. Tell me just what does castration do to prevent sex abuse of a child? Just wondering? |

Death seems a little easy.
You always hear how prisioners take "care" of child molesters. |

Considering the way the death penalty is applied; they would spent 15-20 years incarcerated before execution anyway. Both McCain and Obama are in agreement: lets the states decide how they will punish.

Only 8 comments about this!! I can't believe how people can just let our joke of a judicial system say that raping a child doesn't require harsh and final punishment. The children will never forget and the rapists will just be able to live in the lap of luxury in prison for the rest of their lives.
The Supreme court state that the punishment didn't fit the crime? Well hey what about the ridiculous charges that send people to prison. I say if they don't kill them then castrate the monsters. If it is a woman that rapes a child then remove her clitoris and make her rot in jail. |

But is that really true? I don't know and can anyone really tell us that is true? |

If an 80 year old man with alzheimers rapes his grand child he should be sent to prison (because he obviously didn't know what he was doing). However if your neighbor down the street who knows exactly what he/she is doing rapes your child then damn right put them to death. I don't want to pay to feed, cloth, provide shelter and medical to a horrible person as that. |

Our wonderful judicial system has just let everyone know that they do not see any reason to protect our children. Hey the democrats have no problem protecting children in third world countries, yet they don't see any reason to protect our children here in the US. |

They want to leave it to the States to decide how to punish child rapists because they are too weak and stupid to actually rule on this and make it a law. How embarrassing to have a judicial system like this. I wonder what our four-fathers would think of these idiots. |

Castration would reduce the testosterone produced in the mail body thus reducing their libido. After some time they will not be interested in sex at all. |

Jail is an ugly place and they have codes of their own. I can't honestly say that it's true, but I would imagine it's not far off the mark. Death is final and you can't dig them up if there ends up being a mistake. You might say DNA is 100%, but the Titanic couldn't sink either. I'm just saying, I don't believe anything is 100% and people will always find a way around something that is in their way. Do you see my point? |

There is a difference between a 18 year old and a 16 year old having consensual sex and a 45 year old and a 5 year old. In the first case the 18 & 15 year olds, there needs to be some stricter parental supervision. But in the second the 45 year old has no redeeming qualities that I can imagine. Without redeeming qualities there is no reason for that person to be among general society. You can stick them in a five by five concrete box for the rest of their lives or you can stick them in a pine box six feet under the ground. Lets face it no matter how much therapy, no matter how many pills, no matter if you castrate them or not, once a rapist always a rapist. Once a pedophile always a pedophile. For most it has nothing to do with the fact that they are a child(under the age of 17-age of consent in most states) it has to do with power. A rapist likes to have power over their victims. And who is most powerless? A child. They are easily lured, easily over powered physically, and they are easily frightened into submission, easily frightened into not saying anything to an adult.
But the real problem lies in our justice department. It is in serious need of a major overhaul. Why should prosecution lawyers bear the burden of proving that a person is guilty? If they didn't believe the person to be guilty beyond reasonable doubt they wouldn't have brought them to trial in the first place. The criminal should have to prove that he is innocent of the crime. Guilty until proven innocent not innocent until proven guilty. And another thing why are punishments so easy on the criminal? Those who are sent to jail/prison get three square meals a day, exercise, cable tv, internet access in some cases. They are given jobs with a little pay or are let off on good behavior. They can even earn a high school diploma and they get free health care. The tax payers are the ones footing the bill for the hundreds of thousands of people who are in prison. That doesn't seem very fair to me, you did the crime you pay for your punishment yourself. And if you are sentenced to death you shouldn't get to take the next 20 years to make appeals. You should get a year and then you get a needle stuck in your arm no if ands or buts about it.(Just out of curiosity why do we sterilize the needle and wipe the skin with an alcohol swap first? They are going to die it's not like an infection is going to have time to kill them or anything.) |

I don't think that is a good punishment for that kind of abuse. I think that they should put that dude inside another jail cell of another rapist, and let him get raped to see how it feels like. That would make him stop and make him think twice about what he did to that poor child.

YOu obviously don't have kids. Any parent who's child had suffered in this way would want to see the person responsible dead. It's just human nature. And for most parents they would want to be the ones who pull the trigger, flip the switch, or press the plunger. |
