A penalty? Sure, just like in mandatory liability
insurance for automobiles. If you get caught driving
without the insurance you get a penalty. Some call it
a fine.

If you are an employer and get caught not deducting
Social Security withholding from your employee's pay
check, you get a penalty. Some call it a fine.

Payments into Medicare are not voluntary. They
are mandated.

So why the semantic nonsense?

If you don't want to pay for auto insurance then you don't have to because you can choose not to drive.

The mandate is a penalty.

It is unconstitutional and it will not stand regardless because the law won't work. The people and the states are broke, so even if they wanted to pay, they won't pay.

The states will secceed one by one of the radical leftists attempt to enforce this unconstitutional law.
