Legislature passes law. Courts enforce law. How are people prohibited from entering into legal contracts? They aren't as far as I know. I guess I'm not quite sure what LGBT is fighting for. I thought it was equal opportunity under the law. Our country was founded on the philosophy of liberty which means the right to your life and property. The governments role is to protect that. The only legal inequlity I see for LBGT is directly and sometimes indirectly related to taxation. So when I say goverment out of marriage, that is what I mean. When I say enter into legally binding contracts, that is a natural right and the court is set up to enforce those contracts.
