Ga Court of Appeals OKs Sanctions against Chief Magistrate Martin Valbuena

On March 9, 2012, The Court of Appeals of Georgia recommended that sanctions by considered against Chief Magistrate Martin Valbuena for his active role in a child custody dispute. The Court of Appeals found that Superior Court Judge James Osbourne erred in not considering whether to hold Mr. Valbuena, acting as a private attorney, responsible for filing a custody action in Paulding County when he knew that there was a pending custody case pending in the Coweta Superior Court. The Mother defended herself against Mr. Valbuena, a part-time Superior Court Judge, losing her case before Judge Osbourne but winning on appeal at the higher court.

Despite being told by the mother and Coweta Superior Court Judge Quillian Baldwin that his actions were wrong, Valbuena continued to prosecute the custody matter in Paulding County and Judge Osbourne refused to intervene.

The Court of Appeals directed Judge Osborne to determine if it is appropriate for him to hold the sanctions hearing against Valbuena or transfer case to Coweta County for disposition. The Atlanta Journal Constitution has been very critical of Judge Osbourne for granting special legal favors to his friends and business associates. It is unclear how Judge Osbourne will rule in the matter.

I had to move out of state to protect my children from Judge Fudger, Judge Osbourne, and The DA!
My ex had family that was close to Fudger so he refused to follow the law when it came to my custody case! It took ten years, one child accusing his mom of sexual assault to a teacher at age 7, another born just after her arrest for crack cocain ( in witch she got probation instead of the mandatory 5yrs the DA was suppose to enforce ), and another spending 2 weeks in ICU from a Meth fueled car accident. Where that child almost died and several others wor hurt in the accident. Ofcourse the DA did charge her with felony injury for the other car occupants, just to sit on it till the statute of limitations ran out! None of this mattered any time we went before Fudger, untill she finnally was charged and sentenced to 2yrs prison in another county, then Fudger made me and my oldest that came to live w me once he was old enough to speak up and she was scared of, move from out of state back to Paulding to wait on her sentencing before he would consider hearing the case. Finally, she received her 2yr sentence and Osbourne had no choice but to give me custody of my younger children. It was a nightmare!!! For myself financially, and my children have been permanently scared. I really wish something could be done about the Paulding courts. I feel for any children in that county, the law is a joke there....

There is a pattern here,another case where judge valbuena was the attorney for a very young lady with no money and no means to pay him.She had a laundry list of charges including 4 DUIs and drug DUI child endangerment all in a very short time frame,valbuena had her case postponed 6 times till he got judge osborne in the court room next to his, she walked out with minimum fines and none of the mandatory sentencing

I know some folks that were involved in a custody case where judge Valbuena was the opposing attorney, even though everything took place in another county, Valbuena kept trying to get a transfer to Paulding. He was also on the board for CASA and locked in with the therapist appointed for the kids, the whole thing was a real mess all because Valbuena thought he could get away with anything, it did not matter to him what was best for the children.

Is it legal for a judge to be someones attorney in his court house ?

How does a judge and a lawyer get away with not imposing mandatory sentences? Is there not any oversight in all court cases?

Valbuena is a corrupt Magistrate that uses his office and others in the good ole boy system to allow wrongdoers to win their cases, letting the child abusers and drug attic get away with their actions and misdoings.

I know Martin Valbuena personally and he is a great person. I also read the court of appeals opinion mentioned in this "thread," and have to say that the headline above is false. The Court of Appeals did not recommend sanctions. The party that appealed in that case had already filed a motion requesting sanctions, and all the court of appeals said was that the there should at least be a heaing on that motion (not anything at all about whether the motion should or shouldn't be granted.) Big difference.

Where there is smoke there is fire, I also looked at Cary Jones records, unbelievable!!! How can this happen, 5 dui's,child endangerment,numerous accidents, it looks like it has cost the tax payers 10's of thousands of dollars and she is driving, we are not safe on the roads.
