To Mr. Jorge Perez Lopez,
President of FLA (Fair Labor Association)

Dear Perez, by the special present we write you as representatives of the Haitian victim workers from Cd Apparel S.A in the Sonapi, industrial park of the Port-au-Prince Bldg # 31. As you already know on May 04, 2007 the Leaders of Hanes brands INC with the complicity of the Haitian employers ended their contract with the Cd Apparel’s Plant without any warning throwing into jeopardy the livelihoods of 500 poor’s workers and their families join with the worst tragedy of the Haitian people caused by the Earthquake taken place on January 12 , 2010 that which get worse the economic and social situation of the workers. Note that the illegal closure of our plant violates the Haitian labor law requires an employer to give damages and full compensation to the victim workers because this injustice impede the international social legislation on work which demand you as defender of the human rights to fix your position so that a solution can be done. For the truth and the history, we’re paid to tell you Mr. Lopez that we keep for Hanes by the law 420.000 pieces of T-shirts without forgetting a lot of materials finishing goods at Sonapi Bldg #31 ( six containers ) we please you to let us know your position on this case and your staff one ??? Of more, you had informed the committee of Cd Apparel on a declaration from Hanes pretending that all the victim of this Plant got already obtained “Full Compensation” but without any proof on this lie! For the knowledge of Humanity, we want to declare that the workers did not receive any compensation and damages from an employer in Haiti explaining the critical situation of the victims after the brutal earthquake … To make light on this case we need have a copy of the payroll’s file (doc of payroll) showing how many employees who have been paid? When? The sum for each one of them? In what currency? Like this the truth should be at the main of the international public opinion and demand to the leaders of Hanes to compensate and repair the poor Haitian workers after 4 years of excellent services for their profit and the one of Cd Apparel’s employer but nothing for the victims: What injustice!!!

We look forward to your response for an immediately resolution to this case.

From the committee of Cd Apparel in Haiti at Sonapi Bldg # 31 !

To Mr. C. Ryan Reetz,
member of ICC Arbitration Commission Task Forces on Amiable Solution

Dear / Sir Ryan, as a law man and political, by this special present, the committee of the victims from Cd Apparel at Sonapi is paid to inform your staff and you about a nasty action very brutal which is providing currently in the Sonapi against the poor victims of Cd Apparel’s workers by the contractors of Hanes /HBI in Haiti with the random support of the Haitian’s employer on 30,December 2010 where they came with a International delegation and smash the padlock of the containers holding 420,000 pieces of T-shirts finishing goods without including a lot of materials blocked on May 4,2007 to demand from the leaders of Hanes :“ Damages and repairs “ for the victims as they got done it for the employees of Puerto-Rico, Mexico city, Dominican republic etc… But for what not the same arrangement for the workers of Cd Apparerel after five years of excellent jobs for the profit of the leaders of Hanes brands and his Contractors in Haiti! Note that we keep informing the national and international public opinion, the defenders of human rights, and the trade union sector about the nasty plan to take away the containers hidely for Hanes without any disposal to compensate the victims as you know their critical situation in Haiti after the earthquake on January, 12, 2010 which has been destroying Haiti. For this right reason Mr. Ryan, the poor’s workers please you to fix your position against this crime and pray you to: 1) question Mr. Frantz Joseph Pilorge, owner of Cd Apparel and contractor of Hanes brands / Hbi about this matter to get his position on the bad ecomical situation which is jeopardize every day the past, the current and future of these poor wretch (be 500) and their family. 2) Join the support of your staff and the one of others organization to demand from the deciders of Hanes / HBI: Justice and full compensation for those poor workers in sonapi Bldg # 31 as they get to do it for any plant cancelled!!!

We look forward to your response for an immediately resolution to this case.

We write to you as representatives of workers from the CD Apparel factory in Por au Prince, Haiti at sonapi industrial park building # 31. As you know, on May 4, 2007, the Leaders of Hanesbrands ended their contract with CD Apparel S.A without sufficient warning throwing into jeopardy the livelihoods of over 500 workers and their families. The abusing cancellation and illegal closure of CD Apparel’s Plant by the responsibles of Hanes violates Haitian labor law which requires an employer to give workers twelves months for damages without forgetting twenty months that the workers are getting to demand from Hanes “ Compensation and repair” cause, after the brutal closure of CD Apparel on may 4, 2007 the workwers can not work and can not support their families in their socio-economic situation very very difficult.. The workers are also owed their severance pay and benefits for sixty six months remain unpaid from may 2007 to date. We request that Hanesbrand work with CD Apparel S.A to reach an agreement that will pay workers their severance and benefit pay include their compensation according to the code of conduct and the international legislation for work demanding Hanes’s responsibles to do it for any Plant in any country as they done it for D.R, PUERTO-RICO, CANADA, MEXICO AND U.S.A, once cancelled their Plant.Note that the CD Apparel’s workers: from May 4, 2007 to date are considered as current employees for Hanes via the contractor and owner of this Plant ,everyday they are standing to CD Apparel’s gate to demand their due.
For close to four years, over 500 workers produced T-shirts for Hanesbrands. During this period, we were commended for the high quality of our work and production levels. As a corporation whose Code of Conduct promotes workers rights, we are dismayed by your corporation’s lack of response to workers in Haiti and its violation of its own principles. Without our high quality work, Hanesbrands would not have remained as profitable as it did for 4 years. It’s for that CD Apparel’s Plant has been in the Caribbean the number one for Hanes about production and quality.
Given the very bad socio- economic reality of the Workers in Haiti after the devastating earthquake adding to several hurricane, the illegal closure of CD Apparel, the defiance of Haitian law and the violation of worker rights reflect a direct violation of your Code of Conduct and international labor rights. We request a meeting with you to discuss the severance owed to CD Apparel’s workers and a resolution of the illegal closing.
We look forward to your response and an immediate resolution to this case
Sincerely yours !
From the committee of CD Apparel: César Medna AND Pepée Garlin

Port-au-Prince, April 25, 2013

Hi all, by this revealing letter,me,César Medna am the chief representative of the 500 workers victims of CD APPAREL S.A want to draw the attention of all of my statements that Attorney Evel Fanfan remains the principal author of Sabotage of the Materials for CD APPAREL’s Workers who have been legally sealed by Justice on the recommendation of the Executive Committee with direct approval of the CEO ( PDG ) of the company, Mr. Frantz Pilorge the date of May 2007 to conduct the Battle rightly in Partnership that is in perfect relationship for coexistence to require:1) the abandonment of equipment for HANESBRANDS to the benefit of the Victims. 2) Submit the Case of CD APPAREL, because of Restitution and mending after the brutal and illegal closure of the institution by decision of the makers of HANES as prescribed in Article 48 and 49 of the Haitian labor code and the legal and administrative provisions of the Code of Conduct of Hanesbrands Inc., by ahead the chamber of commerce and arbitration of ICC from Avenue Brickell in Miami Florida in 1111 which was made without the Director Committee, without the 500 victims because Me. Fanfan Evel received secretly or furtively the documents (Manifest) to liquidate the goods (commodity) that were housed in the industrial park of Sonapi seeing that he has as attorney of the Victims all the copy of the seals and his counterpart name James Moise which the person was commissioned to transmit this data to Me. Fanfan is called Marc Guerrier following what has been confessed in his office at Delmas 49 # 16 dated September 6, 2012 in a meeting with the director committee by James Moise about Midday and I am ready and willing any soul and conscience pure to testify by any authority before the whole truth about the matter following legal documents which the lawyer himself had submitted to the Director committee clearly proving his high guilt in the Case or Matter and if we find that Medna lie, slander or libel against Me Evel Fanfan: Without Mandate, without complaint from anyone I dispose myself to go voluntarily to the National Penitentiary as a consistent citizen because the Bible says: The truth needs no proof since it defines, it is explained and it says so be appreciated by all!
