Jack, Thanks for the information, I had backed away from this and had not caught it in any news reports.

I wonder how much money and how many man hours the OTC cost the rest of us by their actions? I am sure they have justified keeping their jobs, unlike being in the private sector where someone would be fired for wasting this much money and time.

Without digging into a bunch of my tax stuff, i cant even remember whats owed to me. Am I safe assuming its 50% of the vehicle purchase price, plus interest? Or is there more to the math based on my tax situation?

@Enid -- as long as you tagged & insured the vehicle, then you would get 50% of the purchase price plus interest. I am not sure how they will get the refund to us -- probably sending out checks which will take several weeks to get thru all the Tomberlin claims.

@ Club Car owners -- this should "open the flood gates" on the remaining vehicle claims. Was Club Car involved in the lawsuit? If so, the remaining vehicles should have decisions soon.

@Cherokee235 -- I never heard anything on television news about this and the story was "buried" in the Enid newspaper. I agree that OTC jobs should be lost over this whole mess and that the Governor should re-evauluate the commissioners and appoint 3 new ones that know what they are doing. The ones we have now cost the State a lot more than if they had just let the credits go thru in 2009.(man hours, interest, legal expenses, ect)

Any tips I can give my accountant? Should I contact the OTC and ask for the refund or does my accountant need to file an ammended return? Any help/tips would be appreciated!

@ Enid -- lawyers are advising NOT to call the tax commission. The OTC will be going thru all of the Tomberlin claims and re-processing them to get us our credits. There are over 700 to go thru. As long as you claimed the credit, you should be in line for your credit. See the link below for the news story:

Good thing we are good at waiting, since we will have to wait a little while longer. OTC isn't supposed to be able to appeal this ruling.

This was posted on the lawyers facebook page today:

"....While appeals from the Tax Commission are filed in the Oklahoma Supreme Court, every appeal is subject to assignment by the Oklahoma Supreme Court to the Oklahoma Court of Civil Appeals.

Our cases were so assigned, and the Court of Civil Appeals ruled in our favor on Friday. The Tax Commission can ask for a rehearing by the Court of Civil Appeals, within 30 days following the ruling by the Court of Civil Appeals.

The Tax Commission also can ask the Oklahoma Supreme Court to review the decision of the Court of Civil Appeals, if they file their request within the same 30 day time period.

This process is similar to an appeal, but the Oklahoma Supreme Court can choose whether to review or not to review the ruling by the Court of Civil Appeals. We will know within twenty days whether the Tax Commission is seeking rehearing or review by the Oklahoma Supreme Court."

** this means more waiting for us, but we are getting very good at waiting. Hopefully OTC will stop spending time and tax money trying to continue this. We will know in 30 days what they decide, so all credits are on hold at least until the end of June. It's important to remember that now 4 different judges have ruled in our favor (Hladik and the three appeal judges) I am hopeful for a positive outcome!

Well, don't start the party yet: it appears that the OTC has 30 days to appeal the Okla. Court of Civil Appeals decision directly to the Okla. Supreme Court (if they choose). So, if the OTC uses all of their allotted time, we may have to wait another 30 days before we will know for sure if the OTC is going to accept the NON-BIASED third party decision (this time) or spend more tax payers money, precious time and effort by appealing the decision again. It doesn't make sense (to me or other prudent folks) that the OTC would continue to fight when the facts are so clear and after those facts have been heard and reviewed by six (6) disinterested judges, in three different venues, and after ALL of these judges who "did not have a dog in the hunt," found that the tax credits on the OTC disallowed LSV's should be allowed. This whole case is not just about Okla. tax credits, but also about truth, justice, fairness, and ethics in politics and government.

@Bobby I've heard/read 18%. Can anyone confirm?

I believe 18% is what the Ruff-n-Tuff owners got. That would mean 18% x 2 years for Tomberlin owners, if correct.

I can confirm that the interest rate owed the taxpayes by the OTC is 1.5% per month, i.e. 18% per year.

It works the same way should the taxpayer owe the OTC.

At that interest rate, I say let them keep your money for another year or so.

I DON'T GIVE A DAMN about electric cars. But I do give President Obama credit for the OUTSTANDING work he has done in order to give us an alternative energy source other than fossil fuel. MAN, WE HAVE A GREAT PRESIDENT!!!!!!!!!!

I wonder how much that "Outstanding Work" cost each present and future tax payer? But seeing that we only have a couple hundred years of "bad" energy efficient fossil fuels available in the US soil, I guess someone has to take the lead. It is just a shame the OTC rejigging like they have on this tax credit for totally efficient cheap electric cars will have a negative effect for any thing like this again. They have lost my trust of promoting anything.

I am a lawyer. Does anyone have a copy of a letter awarding interest or have a cite to Oklahoma law so I can look it up. I would love to have that information. I think the OTC will appeal to the Supreme Court but they will almost certainly lose.

Question - I bought the Club Car and have handled my own case with the OTC without the aid of a lawyer. I did it by the book, providing all requested information and responding in the proper manner to each request made by the OTC. I used the templet from a link I saw on this board. I included exhibits, tax and tag info and so on. The question is, if the Club Care is found to be entitled to the credit, will I receive it just as someone who was part of the group using the law firm? Thanks for your thoughts

@Robert I am in the same boat as you, and did exactly the same. The OTC is still trying to collect taxes due with interest, and have had to call twice to inform them that I am disputing the electric car credit. I came close to paying the balance just to close the appeal. I glad that I did not pay, because there seems to be some hope of collecting our money.

We received the OTC's request to the Supreme Court yesterday asking them to review the decision made by the Court of Appeals.

We have 14 days to respond. Once we respond to the OTC's request to the Supreme Court, they will review the OTC's request and make a ruling on whether or not they will review the case themselves or have the decision from the Court of Appeals stand.

The Supreme Court has no timeline on making their ruling on the OTC's request.

We will have to wait until the Supreme Court rules on this request from the OTC before we will be able to move forward with the tax credits and the other LSV models that have not been heard.
