The repeal of Maine’s marriage equality law was excruciatingly disappointing, but not altogether surprising. As Jesse Ventura put it bluntly, "You can't put a civil rights issue on the ballot and let the people decide … If you left it up to the people, we'd have slavery, depending on how you worded it." Indeed, history has proven that when individuals are given the power to legislate issues directly, the majority invariably terrorizes the minority. Time and time again, the mob has used referenda to repeal existing legislative protections such as Maine’s same-sex marriage law and to ensure that elected representatives are unable to pass new civil rights laws by amending state constitutions to define marriage as being between one man and one woman.

That is where Prop. 8 is right now.
The presiding judge is republican but he is a maverick so I am cautiously optimistic.
He recently asked the Prop. 8 defenders how gay marriages threaten straight marriages and the Prop. 8 lawyer actually said "I don't know".

Going to the federal level won't help. Marriage is legislated and administered by the individual states. The only possibility is to be able to bring the question to the Supreme Court on a constitutional challenge. Given the composition of the present court, I wouldn't say we have much chance of any change.

It's in federal court......Chief Justice Vaghn Walker is residing and the trial will start on January 11th, 2010

The attorneys arguing the case for our side are Ted Olson and David Boies.

If the names don't sound familiar just think back to Gore vs Bush in 2000.
