Does anyone know how far behind in child support payments the non-costodial parent must be before the Department of Child Support will do anything? I know that if he/she gets two months behind they will send a letter out saying something to the effect that "You are behind in child support payments." How many months and/or dollars can they get behind before they will file for garnishment, etc?

I am not sure about the number of payments behind. However, I do know if the costodial parent complains to the system , the system will take action much faster.

Do you receive your child support payment through the State Dept. of Child Support? If you do, then you have a case worker. Call and find out who is your case worker. You must be diligent when dealing with the State.

Yes, I have spoken with my case worker. She acts like I'm a money hungry gold digger everytime I speak to her. I depend on the child support every month to pay for her athletic expenses (she's in competative cheer and gymnastics) and also help with the food bill. Every month that he doesn't pay his support it puts us in a bind. But I don't want to report it every month that he misses because I don't want to seem money hungry. That is why I want to know how far behind he must be before they will take action. He hasn't paid it since May 13th. Do you think I should report it?

If competative cheer and gymnastics is to big an expense maybe ought not do those things. Food on the table is more important than cheering on the football team. If the dead beat dad goes to jail then how is the child support suppose to get paid? I think the pay rate at Marion Co. is something like 1.86 a day. That would buy a happy meal at McDonalds and might buy part of a sock NEEDED for competative cheer and gymnastics. Get real. I am not supporting dead beat dad's... but the Mom's have to be realistic in what they expect. I know of a mom who still expects child support when the child spends every other week with the dad. Actually had the nerve to remind him that he was behind. Ridiculous! And no I'm not sleeping with that Dad. It just infuriates me that some women think that by squeezing out a litter entitles them to $$$ they aren't spending on the child most of the time anyway.

haha....now you know how most of the guys feel. they do what they can and spend all the time with their kid they can and still have to pay no matter what. and the mom is usually livin off the state drawin checks and foodstamps and livin off of other guys. my baby mama is a piece of shit. she's always pawnin our kid off on her parents. i can tell her i sent the support in and she turns around and asks to borrow 80 dollars. she only cares about herself....and i think she's a prime example of most gold diggin hos out there.

In Indiana, the non-costodial parent can get away without paying for years until the custodial parent spends time and money getting it paid when it was already court ordered.

i totally agree!! every case is different... the dads that pay usually cant see the kids and the ones who dont pay want to see the kids.... it just depends on the situation... if the dad pays for the child, let them see and spend time with the kids.... then you have these dead beats out here that dont pay, dont want to see the kids, denys the kid even though paternity is already been proven because he asked for it and got it and prooved him wrong and he still denys her ... dont pay dont want NOTHING to do with my daughter ... what am i to do?? she is actually better off with out him... however it would sure help me out if he would pay ... i asked for him to sign custody papers if i drew them up and paid for them and he said no ... and i was like WTF?? but he wants to deny and have nothing to do with her .... i dont get it!! he is a TRUE dead beat dad

The amount of child support the non-custodial parent pays is based on the amount of money the custodial parent makes as well as any child care, or health insurance payments. The idea is that both parents are financially contributing.

To the unintelligent comment "knows" made about women getting a second job...this cracks me up... it seems to me "knows" doesn't have a clue the time, money, and effort it takes to raise a happy, healthy, intelligent child. I work a full time job as a respiratory therapist...on my days off I try to spend quality time with my son...He attends preschool 3 times per week, takes kindermusik class, goes to speech, occupational, and physical therapy twice per week...The guys that complain about having to pay child support should just give up their rights as fathers...they shouldn't even be called a father...If a father loves his child he should want the best for him...but it sounds to me the deadbeats are the ones complaining about paying child support...It's all about responsibility...
