A third federal lawsuit has been filed to block Furlough Fridays, this one claiming that the decision to shut public schools for 17 days violates students' rights to due process under the U.S. Constitution.

If parents took this much action and concern when their kids were in school, I believe the state's educational ranking would be much higher.

Gotta feel sorry for ambulance chasing attornies Carl Varady, Stanley Levin and Susan Dorsey, all saying they understand our laws to read furloughs violate students' rights to due process. Hello, our founding fathers didn't give a flip about something as trivial as a furlough day. They were more interested in starting our country free from outside influence. Always some babooze attorney who reads between the lines to support their case. Once again the Nei is the laughing stock of the world, well, Nei attornies that is. Yep, just another day in the Nei.

They are going to sue, stupid idiots here in Hawaii. They entire court process is going to end up cost millions of dollars! money that they state and nobody has, so all this will end up putting the entire system in a bigger hole.

most people here in Hawaii are so self-righteous, idiotic and stupid. it's no wonder hawaii is in shambles, the state is only as good as the leaders that you vote for. so, they are a reflection of and representative of the voters.

These attorneys will try anything to get some money. Three lawsuits and so far no results. Talk about wasting money and time and no money coming in. I guess these attorneys got no other cases besides these furloughs suits. It's just a reminder to everyone that these attorneys are not that good in the real world.

Why isn't HSTA named as a defendant!?!?! They put Furlough Fridays on the bargaining table. HSTA knew what they were doing by not using non-instructional days for furlough days or accepting a straight pay cut for the teachers. HSTA hoped the negative opinions were going to be directed at Lingle. Seems like it didn't work.

What HSTA didn't realize is that taxpayers are smarter than that and are fed up with these union tactics. The Furlough Friday fiasco is placed solely on HSTA and DOE.

"Bennett has rejected those arguments as lacking legal merit. He said in court that the state is facing its worst fiscal crisis ever and must cut spending. He argued the decision to shut down schools on Fridays applies to all children equally and does not constitute a change in educational placement for students with special needs. Hamamoto has said the department is working diligently to ensure that services to special education students are not disrupted."

Public charter schools are not furloughing like the DOE. Even being funded at 30% less over the last two years, they are managing to cut elsewhere in order to fulfill their obligations to the children.

Public charters are honoring their primary mission, but the HSTA, BOE and DOE seem to have forgotten theirs.

Anybody can sue anybody.
Yet, this is hardly what a court would consider frivolous. Due process protection exists for a reason, and is a favorite phrase of the unions.
There is additional due process under HAPA (Hawaii Administrative Procedures Act).

Ultimately, this is about the little guy (parents and kids) taking on Goliath.

I am not sure about this article but in a previous article about this subject I thought that the lawyers are suing to have the schools opened so that children can attend school. Not for a money/cash pay out.

Is going to school a benefit? Of what? Be grateful for any and all help that society provides. Parents are the responsibles and there are numerous persons and entities that can/will help. Demanding it? When the monies and efforts that go to the minority jeapordize the services the the majority? What is your thinking? Besides selfish!
