patrick swiney - an injustice in alabama

I would just like to say something. I am not a lawyer, but am involved in a Missouri court case. Missouri Supreme Court overrode the Constitution in the case of Joe Amrine. State decreed that as Joe Amrine had received his constutional right to a fair trial, later evidence of Innocence was not admissable and they were legally and constitutionally entitled to execute Joe. Mo Supreme said No - and Joe is now a free man and working as a paralegal. In my husband's case - they overrode again, and 'reversed' back from legal issues only, to evidence of innocence admissable. Tey seem to be taking the point that if the evidence was there AT THE BEGINNING, but was not submitted for some reason, it becomes admissable if there is cause for doubt. I'm not a lawyer but that's what happened with Arkie. The laws are made for the public, should be applied with common sense and I don't believe for one second that they intended when they wrote the Constitution, for Innocents to be held or killed in its name.

Let's wake up America. This is sooo wrong. READ this!!! This man is Innocent!!! How many others have to endure this justice,whoops, I mean INJUSTICE!!!!!

I just think it is all wrong, i have heard so much wrong lately there is no real justice in the world anymore except injustice for innocent people being blamed for something they have not done, what is this world coming to.

This is an outrage!! What ever happened to justice for all?!!!
Justice will not be served until this man is let go and home with his family!!
What is wrong with these judges? It seems that as long as they have someone to blame for a crime, that's all that matters. It doesn't matter if it is the right person.
Let me check and make sure I am still in America.

it is no wonder, for me, that not much people write a comment here for Patrick. People are selfish more and more.

If they would have the problem, all people shall help immediately...but as long as their own life is funny and good, they do nothing !

Look at Patrick Swiney´s photo. He is such a nice, calm and kind character...how could he harm people ?!

It is only a question of money and bullheadedness, that they let Patrick rot for nothing !

My own best friend Gregory-John Mc Cormick rot in a Michigan prison since 6 years now, and only because he forgot to visit his probation officer right in time.

American Prison Governments can go to hell !

And all the people, who have time enough to help Patrick or my buddy Gregory, can go to hell too. They are not better, than the stubborn Governments !

It is absolutey beyond comprehension how the most 'advanced' country in the world is in the dark ages when it comes to prisons...prisoners. The U.S. has more people in prison than any other country in the world, and instead of rehabilitating them, they do more to dehumanize them and leave them with no hope whatsoever, no wonder they turn to violence!! They have more innocent people..eg. Patrick, who has been proven beyond a doubt that he is innocent and yet they keep him locked up because their stinking pride could not handle admitting that they made a mistake. My prayer is that God comes into those prisons and brings good out of the evil that is prevailing there...my heart is so much for Sherry and her diligence in seeking to have her precious..innocent... husband freed before the system kills him.

If you dont stand up and be counted, you're inviting the system to walk all over you, and your kids. Do you want that? YOU ARE NOT POWERLESS. You may think you are, but you're not. What do you want? Your kids having many memories of a a strong parent, or two kids singing their hearts out to alleviate your failings?

I agree with Chris1. The law and the justice system have totally lost sight of each other. Likewise the integrity of those who manifested the case against Patrick and those who prosecuted it and their conscience. But what can be expected of 'corrupt power'. It is without conscience. It walks the Institutions of every government daily, seeking out the weak to perpetrate their evil upon.

But we've moved well beyond the basics now. Today it comes down to "is there any justice in this country?" Attorney General Gonzales is the man who designed our treatment programs for detainees in the eternal Bush-War Upon the World - programs that violate all norms of human expectation,
in a world that has taken hundreds of years to develop some basic rules for the conduct of war and the treatment of those captured in wars. Alberto Gonzales is the servant of torture and brutality, who gives not one damn about the citizens of this country today.

The Patrick Swiney case is a legal and judicial scandal involving the state's failure to disclose scientific evidence favorable to the accused, destruction of evidence quite possibly favorable to him, the prosecution's misstatement of facts at trial, and sloppy forensic work. Even worse was no desire after conviction to consider new scientific tests that could prove Patrick Swiney innocent.

The State of Alabama appears more concerned with avoiding a major scandal than securing justice. The courts, both federal and state, seemingly favor the finality of conviction at the expense of due process and candor.

Law based on equity never works. It allows the power to devolve into smaller and smaller arenas, away from the very people who fund it. Patricks case is stark example, but only one of millions. The blending of equity and law, of currency control and its effect on justice, has only nurtured great pain, suffering, and ignorance.
The law here now is british law, copyrighted code replacing our consitution for international financiers whose predations have stripped us of natural resources, intellect, and now, our freedoms. Consider the absurdity banning the cultivation of certain plants. If that is not enough to convince you something is seriously wrong, well maybe you might like to check your pulse, see if you are not Dead!

A sad period in human history where the world and its citizens is being ruled and controlled by the real criminals whose nepotism thrives in every Government and Judicial department.
The so called Justice system particularly in the USA has been tragically hijacked, a Government Coup has ensued and the Americans are being governed by corrupt fraudulent individuals who have illegally stolen their honourary positions/elections and seek to hide behind their duplicity by cowering behind their criminal Mask, and willing to frame the innocent in order to protect the evil doers and all their associates, irrespective of any and all evidence that proves the legality of one's innocence. Their contempt for the law and true justice is all the more apparent with the continuous infringements on liberty and Human Rights which they now seek to abuse, using their phoney new laws/Patriot Acts to protect their own misdeeds for which THEY and not the innocent, should be incarcerated for. It seems the innocent are used and abused while the guilty party ensures its survival by depriving others of their freedom for crimes they did not commit. The truth is out there as is Justice which one day will catch up with the real State and War criminals within the entire US Government, Military and Judiciary. When a man's innocence has been proven, the Law and its true followers within our law abiding community must return this man's freedom to him and compensate him for the damage false imprisonment and emotional upheaval his wrong imprisonment has inflicted upon him
The proven evidence is there- free Mr Swiney if you are a real democracy that believes in freedom and justice and apologise to all the innocents you have wrongfully and sadistically locked up. Mr Swiney has paid the ultimate price with his ailing health for his innocence and forced incarceration for crimes it appears, he was set up/framed for - and that is a miscarriage of justice.

I wonder if the prosecuting attorney and some of the people in that courtroom can lay their heads down at night,..and sleep well???? It's such a shame! America has come to this. Land of thee Free and the Brave, freedom of speech- bull! I can only imagine the innocent people they already killed. Their blood is on their hands. They will have to account to the Supreme Judge one day... Patrick Swiney IS innocent!!!!

hi sherry, thought id stop by a leave my comments. you and patrick have been thru so much all ready and the toughest to come. i dont know what it takes for the court system to come to grips with their systems are not working. there are too many locked up wrongfully and lack of proper investigations and procedures are the result in so many innocent being locked up, along with corrrupt officials. when does the justice come?! it is up to us all to stand together and stand strong in our efforts to get our system reformed, free our innocent loved ones and anyone else we can help. we must be thier voice and their defenders. please everyone support each other in all our efforts to bring justice back to america.. the land of the free. lisa richards/ another innocent pawns wife

I've spent lots of time investigating the death of Patrick's wife and her lover. A different culprit than Patrick kept appearing in my periscope. Each and every time I tried to get to him he proved to be Teflon-coated. Could it be one of the MIGHTY good-ole-boys, having behind him the "mighty" Alabama Justice System, protecting him and making sure he will not bring shame to the Justice System of Alabama??? How guilty was Patrick, or was he guilty at all? The evidence presented or procured has not convinced me of his guilt. During my interrogation Patrick was open, honest and cooperated with me to a full extend. Patrick's defense was poor and almost afraid of the prosecutor and the judge. It became obvious to me that Patrick was earmarked for culpability. Now the Justice System of Alabama covers up their misdeeds by blocking new evidence, which proves that Patrick could not be the shooter. Mr. Judge – the bullets always make a hole in the window pane. If this one didn’t, than it never happened the way the prosecution won their case. Hidding the evidence favorable to the defender qualifies as Brady material and the whole case should be dismissed, or at least retried.Brady material consists of exculpatory or impeaching information that is material to the guilt or punishment of the defendant. Brady material is favorable to a defendant and cannot be suppressed by the prosecution. The prosecution is required to disclose to the defense some evidence or information it has if it would prove the innocence of the defendant.
...and Mrs. Swiney...she is the real heroine fighting the injustice done to one little guy who served his country well in the ranks of Law Enforcement.

I fail to see what is wrong with these judges when the proof of innocence is in plain view in front of them in the form of a motion. We all know how many of these things have to be submitted to one judge after another and they all deny the motion when the truth is well substantiated yet they continue to deny it any way. How can this happen??? I think it's because they are afraid the state will have to pay restitution to this wrongly convicted man so they are looking out for the welfare of the state regardless of who it hurts just like they are doing to Patrick Swiney now. The thing about Patrick Swineys case is that it is so obvious that he is innocent and anyone who reads the motions and proof of his innocence would have to rule that Patrick Swiney is innocent of the crimes of which he was convicted. So why is it that the judges continue to deny this man his freedom? Patrick Swiney is innocent and needs to be released and the criminals who did this crime are free to do as they please. I just don't get it and where are the judges who are suppose to protect our rights? No judge is Alabama is protecting Patrick Swineys rights! Alabama needs to stop putting away innocent people and make the system of law work the way its suppose to work. If we continue to arrest and convict innocent people then our laws are not working to protect the innocent and the judges are failing miserably in the courtroom. Judges, read the proof of innocence in Patrick Swineys case and let him out of prison! Everyone is watching you even those of us in other states. This is a prime example of how our system of law is not working. No innocent person should be limited to how many times he/she can petiton the courts attention to their innocence. No limits!!I mean the judges can read in Alabama right!!
