Why do you concern yourself with what some jerk says? This is a waste of energy and takes the focus off what is important. I posted a post where an attorney actually stood against the system,yet no one commented on this, but you only became another idiotic fool when you stay on this guys bandwagon. This is exactly why ALL these people that are innocent and locked in a prison cell get so little to no help at all. Each one of you needs to stop talking out of the sides of your mouth just to go along with what others believe and stop these baseless battles with these idiotic fools that often post on these threads. Once these baseless comments with their responses are posted, intelligent people no longer care to read them. Find out who you really are and say what you believe in your heart and not what you think others will want to hear.

Answer: It depends on the mental state behind using this expression! If this is Hate or Anger, then this is wrong and harsh speech! If this is Kind Understanding, then this is right & good speech!
Saying what is true and advantageous cannot always be kind, but one should know the right time for using rough speech in order to shock to move or advantageously wake up! If you were stuck in prison for a crime that you did not commit, would you want people to focus on some idiotic fool's comments who obviously feeds off the misfortunes of others and who gives support to those that are superficial to these wrongs and to the injustices that have been perpetrated against you, or would you want them to stand together and be dead serious about fighting the terrible nightmare that has be manufactured by a bizarre legal system against you and your family and loved ones?

SUPPORTERS PLOT NEXT STEP TO FREE SWINEY

Family, friends and supporters of a former Alabama police officer are huddling with legal thinkers and human rights organizations to determine the next step in obtaining his freedom following a recent decision handed down in the U.S. Court of Appeals 11th Circuit which the State of Alabama hopes ends this case.

Patrick Swiney, 62, was convicted on circumstantial evidence by a jury of capital murder in the 1987 shooting deaths of his wife and her ex-husband in Saginaw, Alabama. He has consistently maintained his innocence.

In the most recent court decision, the 11th Circuit Court of appeals denied Swiney’s request to show his evidence of actual innocent to the Federal District Court in Alabama. The AEDPA (Antiterrorism and Effective Death Penalty Act of 1996) requires a litigant to ask for permission to file a second habeas corpus in Federal Court. The U.S. Code says that,“But for Constitutional Error,” the person would not have been found guilty. The 11th Circuit ruling said that Swiney’s request failed to meet the “Constitutional Error” test because his request was not sufficiently pled.

Swiney’s defense team had submitted a 20-page motion revealing details of exonerating evidence hidden by the prosecutor at trial that the jury never saw. The 11th Circuit Court returned the motion with instructions to use the court-approved short form, making it impossible to plead the case and then denied the request stating that Swiney had not provided a prima facie showing of innocence.

Swiney’s exonerating evidence includes:

A. Crime Scene photos found in 2002 that show no bullet hole in the kitchen window or screen, contrary to the prosecutor’s claims;

B. Police records showing that Patrick was 10 miles away from the crime scene at the time of the shooting;

C. Forensic reports found ten years after the trial proving that there was no gun shot residue on Patrick, or blood on his clothing, including his shoes; and

D. Newly discovered GSR (gun shot residue) evidence by a renowned forensic scientist that proves Swiney was not and could not have been the shooter in this crime.

Mrs. Swiney said that these and other items of proof could not have been found previously because they were either hidden from view by the prosecutor and found decades later, or not discovered through forensic science until 2003.

Mrs. Swiney reports that the second Habeas Corpus petition and its exhibits can be seen on the Internet (google Patrick Swiney), so that everyone can see how solid the proof of innocence really is. Stung by the recent decision, she said that in “the real world” this would be considered a violation of due process, but “in the world of the 11th Circuit Court, this is not sufficient to show that the prosecutor or the state did anything wrong.”

Patrick Swiney has suffered severe health problems while in prison over the past 17 years. His wife and supporters say that since the court decision they have learned that permission from the court wasn’t necessary after all. When evidence could not have been found at the time of the first habeas petition, the second is not considered “successive” or an abuse of litigation which the AEDPA was initially designed to prevent. An Amendment bearing this claim has just been filed, in the hope that Swiney will now be able to show the Federal Court his evidence of innocence. Said Mrs. Swiney:“There is no statute of limitations on murder, and there should be none on innocence!

Just looked op that website - interesting. Parody writeen by two young sisters - Wendy Morrow was all of seventeen and a bit of a handful by the looks of what she's written. Wouldn't be surprised if Patrick Swiney had given her a warning at some time and this is her 'revenge'. The 'toughest cop in town' is satirical - in other words, you're a wuzz. You seemed down to earth Joe B - so which clan do you reckon she and her husband belonged to in a previous life? MacLeod, or Stewart? She has regressed back to her previous lives after all, and has known her husband through each and every one of them. The day you start believing parodies without checking out the rest of the website is the day you should go calling the men in the white coats.

Alabama courts are full of injustice. The injustice is covered up as long as they can keep them covered. It's only until you find the right people (good people) that steps up & takes charge & helps the innocent & gets justice brought forth.

I found Patrick Swiney's site after searching for "corruption and Alabama," as my son is said to have "committed suicide with a shot-gun" in Alabama: Baldwin County. Letters to Alabama's Attorney General, and other "authorities" have produced nothing more than just more brick walls. I'm not surprised Siegelman, Alabama's former Governor, is facing prison, and surely there are more yet to come.

That Patrick Swiney has been in prison all these years, convicted in an Alabama Kangaroo Court: isn't surprising. It's what happens when good, honest police officers or citizens have the ability to expose very powerful elitists and political dynasties who are long-entrenched and hopelessly corrupt. Destroying the life and family of that one "whistle-blower" certainly sends a message to anyone else who would seek to be honest, and expose corruption.

The experiences I had in trying to get information regarding my son's death was an unbelievable "runaround." In the midst of it, living in another state, I have continuously suffered sabotage to my home and property, been targeted for police persecution and arrest, and dodged vehicles who would create accidents.

The Mobile, Alabama autopsy report details proves the body claimed to be my son was not his. He never had "shoulder length hair," nor did he have 3-inch scars, healed above each knee.

Apparently, from other reports I've read, Alabama and Florida's panhandle are places to avoid. And it seems all states are connected via organized crime and drug lords,(and their political candidates, and attorney friends?)

Communist Russia was little more than this same scenario.(Elitist Mob families running the government - in the background.)

I have suffered false arrest and been in five jails trying to uncover the corruption involving my own family. It appears the police are helping the bad guys. All I can do is try and imagine the next "frame job" or legal trickery "they" will plan.

We live in a narco-pill-pushing terrorized republic and have been for several decades. It isn't "the Muslims," but we have a country infiltrated with criminals, even at the highest levels. Maybe that's why Patrick Swiney is in prison.

He apparently knew it - a long, long time ago.

And now we endure the dominoes falling in the Republican Party with the Mark Foley scandal.(And the Democrats are pure and "squeaky clean," right?) Tommy Schlette of Melborne, Florida maintained my son was still alive, lies had been told, and just before he "overdosed," May, 2006, saying he "golfed with Mark Foley." He worked for Pinkerton Government Security protecting a Bush Facility, Vaught Aircraft, Stuart, Florida.
In fact, he was the one who told me to more closely examine my son's autopsy report.(It was something I found it difficult to do, as a Mother, still grieving.)
Patrick Swiney is a victim of a corrupt area of Alabama operative for decades, and includes the Florida panhandle where our current Governor-under-investigation (Kentucky) has investments - Destin.(Who are his investment buddies? Just curious.) There are all kinds of stories about Alabama, even Skynyrd sang about it... "We all did what we could do.... does your conscience bother you?" Then they died. It seems to happen to "outspoken" musicians.
It's all about GREED, MOB and Dead-Gambling-Discarded-Greyho und dogs: buried there for $5 per dog, because probably in Alabama, like Kentucky there are two classes: the few very old, dynastic, rich families that keep everything covered up, vs. the many, many: very poor. Where else could the MOB BOYS get rid of some useless greyhounds, cheap - but where folks are desperate to feed their children and survive?
Perfect scenario for crime, drugs, and corruption while the "rich" get richer, keep their crimes covered, and the desperate poor and addicted drug-slaves, and runners: go to prison to be silenced.
"There's this rich woman in Kentucky. She killed her husband, and she told this guy, "You take the rap, and when you get out of prison, I'll give you a million dollars." (He's still in prison.)
I believe that story.
Where I live in Kentucky, "overdoses" and "suicides" are rampant... and the big "dope boys" are running away with the laundered money: scot free, just like they have for the past forty years. They're running the towns and the government.
(And NOBODY trusts the coroner, anymore.)
Is Patrick Native American? That could have something to do with it. They're often just too "honest," for our present system.

I wish I could help I've been looking for anwsers my self they have my son who was 16 yrs old locked up in virginia for a murder he did not commit you need to go for a pardon through the governor thats what I'm working on there is a pardon that states someone who is very i'll will get out I'm learning. My aunt in california has a dear friend who is very into this kind of thing helping the wrongfully accused.He wrote the book the in just justice system his name is theodore p. ponticelli I hope that can help some how.

If you want to write about something "injust / rotten" you need not come to the free and fair United States of America. Injust / Rotten / Yellow / Incompetent = Netherlands/Holland/Aruba. Fix that then fix the US. Otherwise, go away and don't come back Jack. Obviously the USA is 1000000 better that anything in Holland. Always has been, always will be. Let us know when you need the USA to save your sorry yellow liberal commie behinds again and please don't whine.

It was not until recently that I semi-retired from Law Enforcement. A large part of the reason was the constant travesties of "injustice" that I saw over the years (over 10 years)and always trying to "do what was right" and having the justice system crap on us. I have now discovered numerous reasons to look closer.....

Cullman County is one of most corrupt communities in world. The judge works for the D.A. office. Confidential informants are arrested, charged, and indicted in order to convict innocent individuals based on complicity theory. After the innocent person is convicted, the bogus charges against the informant are dismissed by the corrupt judge. Criminals can buy their way out of crimal prosecution by becoming a confidential informant and act out purchasing drugs from an undercover cop. The indivuals with the informant are then prosecuted for being as an accomplice.
The poor sole goes to prison for trafficking in drugs, but in actuality he goes to prison for helping an informant get out of commiting a crime.
Cullman County doesn't hold a candle to Russia, North Korea,or Nazi Germany.
