Pool company president to be arraigned for boy's death

A pool company president charged in the drowning of a child is expected in court today to face manslaughter charges.

Why was a six year old left in a pool without supervision? Yes the pool company messed up by not installing the devices, but a child can just as easily drown in a bathtub or kiddy pool if not supervised. You can not lay all the blame on the pool company and charge the owner with manslaughter, if thats the case charge the parent with reckless endangerment. Both parties need to share the responsibility.

....I'm sure the president of the company didn't install the pool, so we would have to bring his workers up on charges as well...right??? If you charge one, you might as well charge everyone....the town inspector, how about the "workers" for the family?? I'm sure they got paid to "supervise" the children.....it doesn't make ANY sense!!

I read in another post that the mother didn't know how to turn the filter off? If that's true, she's just as much at fault...how do you pay that much money for something that you have no idea how to work and stick your kid in it?? The parents and inspectors should be held accountable on the same charges as this man...and be unable to sue...

From the looks of the estate, I'm sure the mom didn't have to lift a finger to do anything, nevermind know how to turn off a pool pump, that's what the poolboy is for!!

When I was 6 I was never allowed in our pool unsupervised or with out a life jacket. Where the hell was the mother & father???? Eating bon bons and sipping champagne while the nanny was made to watch the kid and clean the house and do the laundry???? This is ridiculous. The parents should be arraigned in court not this guy? And how many years ago was the pool put in?????? Of course the parents want to blame the pool guy. They dont want to take the blame for their child. This poor guy must be going through hell right now.

It sounds like the prosecuting attorney is going to run for office. Why else bring such a politacally motivated charge?
These situations are what civil court is for. It's time to remove the blanket immunity that prosecutors enjoy.

Sometimes being rich doesnt buy you everything, especially a life that is priceless. Suing isnt going to bring the boy back. It was negligence on the parents' part and nothing will ever fill that void of guilt.

This company sure holds some fault for not following the law. They installed the switch in a bad spot and did not install the nessasary safty requirments. Although they have a little blame it is civil and not criminal. If they continue to do the same things then it becomes criminal.

The president should not be held responsible. Other's should be to blame, not him. This seems so unfair that it has even gotten this far. I can see some blame being dished out, but other people are sitting back watching all this happen and they should be having the finger pointed at them. I don't think this is fair to press criminal charges against the man. This part of the case should immediately be dismissed.

Lionetti's lawyer has said his client didn't know about the safety law that took effect in 2004, and there has been confusion about the law.

He is being held responsible because he is the owner and those under him follow his direction. The pool was built after the new safety requirements were put into law and he did not have his employees follow the law.

If all the other pool companies knew about it, he had to. He, and his workers didn't do their jobs properly, but I still say all the fault is NOT on them. The parents should have been watching the child, so they are just as much at fault, if not more, then the pool company owner.

I agree, I would like to know who is taking a look at the inspection reports and who let the pool pass inspection.

The law is they have to install safety devices just like in apartment buildings if you have a child under 5 i believe it is, they have to install bars so the child doesnt fall out the window. It was probably a ten dollar part that was overlooked. Such a tragedy. I would think the parents should be held responsible as well.
