BUFFALO, N.Y.(WIVB)- The battle over the Buffalo Creek Casino enters a new round.

The National Indian Gaming Commission issued a notice of violation, ruling the Seneca's are operating in violation of Federal law.

The commission did not order the Seneca's to immediately close the temporary casino.

The Seneca's said they will immediately appeal and keep the slots running in the meantime.

This follows a recent ruling by a Federal Judge in Buffalo that gambling on the downtown parcel is illegal.

I know I am not the only one who is trying to figure out how a dozen or so people on some little made up commitee could stop the progress of an entire city. I disagree, it is not dead! There has to be a way to intervene on behalf of the economic benefits this project would bring. What about a class acton lawsuit against the members of the CFBB and Wendt Foundation under the eminent domain laws? How about a federal injunction to stop legal action against the casino until a referendum vote could be called? Why can't the city file a harrasment suit against the CFBB or an investigation to see what interests anyone had BEFORE the Senecas bought it and try and find out if anything smells fishy? How about placing a casino "boat" or pier just off city property, but accessible to the casinop so the entrance is not on city land?.....C'MON FOLKS.....LET'S GET CREATIVE AND WARM UP THE TAR AND FEATHERS FOR THESE ENVIOUS SILLY LITTLE PEOPLE. What a joke their name is too......."Citzens For a Better Buffalo".........CFBB should really stand for Citizens For Bashing Buffalonians.

Whether you agree with the Court decision or not, you have to realize the casino, as it stands today, is illegal. If you want to blame someone, blame the State, The Senecas and the NIGC for ignoring the law.

The people need to vote on the legalization of commercialized gambling because in order to permit it we must amend our State Constitution to permit it.

We voted to allow pari-mutuel horse-racing, the lottery, bingo, and games of chance for charitable organizations.

What I do not understand is if a casino will bring so much to the area why are we so willing to settle for just one? If all this positive economic growth comes from this why do we not amend our Constitution to permit open competition in this industry rather than just granting an exclusive franchise (which is also against our State Constitution)?

Why are the casino supporters waiting for someone to hand them what they want? The apparent lack of any effort, let alone organized, to legalize this activity demonstrates that either it lacks any true support and those who support it are the vocal minority or those that do support it are too lazy to work for what they want.

YOU and others can't get it through your head that BY TREATY [ TREATYS are above all laws of the land and come first,]THE SENECAS are an IND. NATION , a country all by its self] BY THIS treaty have the rite to buy back LAND that was taken[ stolen] from them and can do on that land what ever they want, and we the people of EIRE CO, STATE OF NEW YORK. UNITED STATES DO NOT have any thing to say about it . and when they [ THE SENECAS ] see this and it won't be long ' they will go to the world court as an ind NATION and get them to rule that one country can NOT tell another country what they can or can not do with their land . EVEN if it is in DOWN TOWN BUFFALO.

P.S. go and look up the treaties that have to do with the SENECAS/ you will NOT find anywhere that it says that tha SENECA NATION is part of the UNITED STATES. IT is always refered to as "THE SENECA NATION" Not the senecas of the UNITED STATES.

Which treaty gives the Seneca any right to a casino?

What you do not understand is that we stopped entering into treaties with the Indians in 1871. They became citizens of the United States and the state in which they are situated in 1924. That they are domestic dependent sovereigns subject to the plenary control of Congress. Congress enacted the Indian Gaming Regulatory Act ("IGRA"). Judge Skretny ruled that the Buffalo Casino is not permitted under IGRA.

I'm trying to figure out why they didn't build the
casino on the Irving Reservation. It has the SAME
number of attraction to draw people to visit.....
the number is NONE. Buffalo's got nuthin and so
does Irving...oh, I''m wrong....there's Sunset Bay
and the convention center in beautiful downtown
Silver Creek. Not.

Seriously, why not build a large casino next to all
the smoke shops and gas stations....that way I can
fill up my tank, buy cheap smokes, "donate" a couple hundred dollars to the Sovereign Nation and
New York State, have a few drinks and then cruise
home all happy like.

The problem with representational government in
NYS is that NOTHING ever gets through the NYS
Senate. Period.
I don't think that the changes you suggest and that must be made as you suggest, would ever have enough popular support to make through the State
Legislature.

You cannot say that NOTHING gets through the Senate. There are a number of bills that go though and are approved by both houses each year. In any event the voters will have an opportunity in 2017 to vote on the question of whether or not we should convene a State Constitutional Convention.

LOOK that up again. THAT treaty made them citizens of the U.S. AND the SENECA NATION. and never took their SOVERN NATION status away from them[ I sat here several times and read the treaties over and never have I seen that they gave up being their own NATION.] SO they should still have the rites as any other NATION and if going to the world court is one of them then they should and tie this mess up for 50 or 60 years[ if it is in court they still can do on their land what they want.]

It was an act of Congress that made them citizens. Also they are not sovereigns in the sense that Canada and Mexico are. The United States Supreme Court has stated in Nevada v. Hicks, 533 U.S. 353, 121 S.Ct. 2304, 150 L.Ed. 2d 398, "Our cases make clear that the Indians' right to make their own laws and be governed by them does not exclude all state regulatory authority on the reservation. State sovereignty does not end at a reservation's border. Though tribes are often referred to as "sovereign" entities, it was "long ago" that "the Court departed from Chief Justice Marshall's view that `the laws of [a State] can have no force' within reservation boundaries. Worcester v. Georgia, 6 Pet. 515, 561 (1832)," White Mountain Apache Tribe v. Bracker, 448 U. S. 136, 141 (1980). "Ordinarily," it is now clear, "an Indian reservation is considered part of the territory of the State." U. S. Dept. of Interior, Federal Indian Law 510, and n. 1 (1958), citing Utah & Northern R. First of all why is it that anything that could bring some life back into this city is always shot down. We need a boost and it isnt bass pro. yeah right I can see thousands flock to vacation here to go buy all of thier fishing needs. people are going to do what people are going to do if there are degenerate gamblers out there that would go to the casino so be it that's thier business if we are so worried about people's lives being destroyed over this casino then maybe we should pull all of the lottery tickets out of every store we walk in or maybe shut down every church bingo hall.
Leave the Seneca's alone they are trying to build something here that will draw people back in to our city and with that think of all the restaurants, shopping centers & clubs that will be making money as well from all of those people who will be drawn here.
Just my opinion not looking to anger anyone and debate.

Give them [ the Senecas] time , they will come out on top, it is sad that people of Buffalo sued to make them build a casino down there and then the people of Buffalo turn around and run back tocourt to stop it, well one more section of Buffalo with nothing on it and will look run down, OH just like the rest of the city.
