The dismissed cases regarding her criminal prosecutions of medical marijuana patients are available as public records at the Ukiah courthouse. A few of Lintott's victims names have already been made public, including Hamburg and Pinches. There are hundreds of other cases for any investigative newspaper journalist like from, oh say the UDJ, to write an expose of what's going on at the DA's office. That reporter might also look at the ADA grant Lintott gets, specifically the part that says: "The Anti-Drug Abuse Enforcement Program (ADA) is funded by the Governor’s Office of Emergency Services (OES). This grant promotes the vertical prosecution of all commercial drug cases (e.g. heroin, cocaine, methamphetamine, LSD) WITH THE EXCEPTION OF MARIJUANA CASES (my emphasis). Grant activity includes prosecution for the sale, possession for sale, transportation and, with increasing frequency, the manufacture of methamphetamine. The assigned Deputy District Attorney, DA Investigator and DA Staff Assistant work closely with the Mendocino Major Crimes Task Force, the investigating agency for the ADA grant cases." It should also be brought to the attention of the voting public that despite the Mower ruling and other caselaw precedents telling local judges that if criminal charges are dismissed because of MMJ, the marijuana HAS TO BE RETURNED to the patient , the Honorable David Nelson has taken it upon himself to dismiss the MMJ prosecutions but ordering the confiscation of patients' marijuana as CONTRABAND. Nelson seems to think he has the judicial discretion, DESPITE HIGHER COURT RULINGS, to punish patients anyway by calling their medicine "contraband". Maybe the California Commission on Judicial Performance AND/OR the voters should ask him about him why he thinks he has the authority to do this in his court? |

I would tend to think that if any of those prosecutions that were dismissed were of the same type that had been dismissed before, and the subsequent charges filed after the prior dismissal, then the malicious prosecution charge would stick on the latter cases. |
You raise the interesting question of whether the Mendo Major Crimes Task Force may have conducted at least some of its recent flurry of highly publicized activity, supported by State funds, in a manner at variance with the specified, authorized use of those funds. |

Doctors wont recommend a dosage because cannabis is different strength in different forms and different strains act differently on different people. Also the CMA say that they shouldn't recommend a specific dose, for the same reasons. |

Just wait till all these people that had their cases dismissed file for return of property......and the county has destroyed it....and is then forced to pay for it.....@$3200 to $5200 per plant and pound.....

What they need to do is file an appeal to a hiogher court, where they will get satisfaction. I quote from the more recent KHA desision.... "Appellate Court: Local police must return medical marijuana to patients if found to be lawful under state law, regardless of federal law.. "Mindful as we are of the general supremacy of federal law, we are unable to discern any justification for the City or its police department to disregard the trial court’s order to return Kha’s marijuana. The order is fully consistent with state law respecting the possession of medical marijuana, and for all the reasons discussed, we do not believe the federal drug laws supersede or preempt Kha’s right to the return of his property. That right has its origins in the CUA and MMP, but it is grounded, at bottom, on fairness principles embodied in the due process clause. If a judge is violating that he is breaking the law and should be sanctioned. |

Yeah, you're right. But who has the money to pay the attorneys fees and legal costs it's going to cost to go after it? Who can afford justice? It costs my buddy nearly $25,000 in attorneys fees and legal costs and lost wages to fight the bogus criminal charges Lintott laid on him. That's two years of mortgage payments on his house down the toilet because of Lintott, and that was just ONE of her victims. There are hundreds in the court case files. Then, adding insult to injury, we got Nelson calling all MMJ seized from patients CONTRABAND and refusing to return it. These people, Lintott, Allman, and Nelson are ELECTED officials. I'm all in for un-electing them ASAP. |

Damn straight. Whose going to hold her and the "Major Crimes Task Force" accountable if we, the people, of Mendocino County don't? Answer: nobody. |

It may be difficult with MMCTF as they are State funded and although "Agent" Nishiyama has a desk at the MCSO it is my impression that he does not work for them nor fall under their chain of command. |

He sure doesn't return phone calls to that desk asking for status reports on the 'pending' investigations of a number of dead potheads, that's for sure. I called about a half dozen times, following up over and over after he read a laundry list of dead people on the radio last year. |

Sheriff Allman stated Nishyama does not work for MCSO. |
It seems like it would be simple but it's difficult to damn near impossible to nail any public officials for malicious prosecution. They have dozens of loopholes written into existing immunity laws. Cops use these loopholes to, literally, get away with murder every day. In the case of elected officials, like Lintott, Allman, and judges like Nelson, an ounce of prevention in the voting booth is whole lot cheaper than the pound of cure it takes to get rid of them. |

Richard Haley will state that, for all appearances, Nishiyama doesn't actually work (or at least, hasn't returned multiple messages in six months or more). |
