It should also be brought to the attention of the voting public that despite the Mower ruling and other caselaw precedents telling local judges that if criminal charges are dismissed because of MMJ, the marijuana HAS TO BE RETURNED to the patient , the Honorable David Nelson has taken it upon himself to dismiss the MMJ prosecutions but ordering the confiscation of patients' marijuana as CONTRABAND. Nelson seems to think he has the judicial discretion, DESPITE HIGHER COURT RULINGS, to punish patients anyway by calling their medicine "contraband". Maybe the California Commission on Judicial Performance AND/OR the voters should ask him about him why he thinks he has the authority to do this in his court?
