Wis. woman convicted of fatal bicycle crash sentenced to 15 years

Why wasn't the bar owner tagged in this match as well, like when a drunken customer causes injury? Were the prosecutors afraid to follow on this theory?

According to the article she was the bar tender on duty. "According to the criminal complaint, on the day of the crash Burr had seven beers and two whiskey shots while working the morning shift at a Neenah tavern." No one else can drink on the job, why should bartenders be able to? They can drink non-alcohol drinks while on the job. No wonder so many people keep getting served after they are intoxicated. A drunk bar tender doesn't care about the safety of others.

This is closer to the type of sentence that I have been advocating for years. I would prefer that the charge of second degree murder be leveled instead of these watered down charges. However, compared to MN this is a HUGE improvement.

NEENAH, Wis.- A Menasha bartender accused of being drunk when her car plowed into three bicyclists Sunday afternoon, killing one, told police she had been drinking since 7:15 that morning, authorities said Monday.

Sheila A. Burr, 47, was charged with one count of causing death by drunken driving and two counts of causing injury by drunken driving.

A man and two women from Neenah were biking across the Fox River near Theda Clark Medical Center when Burr's vehicle struck them from behind.

Robert W. Melzer, 53, died about four hours later at the medical center, police said.

Ruth A. Melzer, 46, was in serious condition Monday. Joanne A. Grobe, 59, was treated and released Sunday, a hospital spokesman said.

After the crash, Burr was quoted as saying, "I can't believe I hit those two people" and "I can't believe I hurt somebody," according to the criminal complaint.

Burr told investigators she had a beer at a Neenah bar around 7:15 a.m. Sunday and then when to a second Neenah bar where she worked as a bartender, the complaint said. There she drank about four beers and two whiskey shots until her shift ended at noon, the complaint said.

She stayed to have two more beers and left around 2 p.m., prosecutors said.

In a witness statement, Dan D. Hamilton said he "heard a loud noise and looked in his rearview mirror. He saw a car bouncing off the curb of the bridge two or three times and saw two bikes that were airborne after the impact with the vehicle."

One victim bounced off the windshield, he said.

Tony Kuranda, who also saw the accident, said officers had to support Burr as she walked to the squad car because she had difficulty standing on her own.

"She was all surprised," Kuranda said. "At one point she said,'Did I do that?' when they were hauling the victims away."

Burr is scheduled to make an initial court appearance Tuesday afternoon.

If for nothing else, people like this don't get enough punishment or stop drinking and driving until they kill or seriously injure someone. And we just let it keep happening. Who is drunk by noon? I don't know this woman but if she is bartending and drinking along with the patrons, you're right, how many other people left that bar in the same condition and didn't get caught this time?

In Wisconsin, as in many other states, the legal limit for alcohol is .08. In most people that is acheived after 2 or 3 drinks. Most people leaving the bars, after a few, would be in violation of .08. In fact most DUI's are for 1.4 - 1.9. So how many and who drives drunk on the highways?? When is it going to be your unfortunate day???

1.4 and 1.9 you'd be dead! Don't you mean .14 and .19.- actually most DWI's now are between .09 and .13

Depends on your lawyer. You get what you pay for. Look at the little canada one..30 day I think she got for killing a little boy. She wasn't drunk but hit al 4 brothers...bowling pins
