An account apparently nobody in the family knows about!! There are legal issues here too Bill. Since there are kids by different mothers how are people to know the money will be evenly split between the kids. Why not encourage a lawyer to step up to the plate to set up a trust instead of giving to account that may or may not go to the family or evenly to all the children?

It is disheartening to see you misconstrue what it is Mike and I do. Our research in these types of cases are well known. Did we not investigate the background of Wade Myers? How about Juan Soso? Were they on trial for murder or the prosecution's witnesses? Did their history not play a part in discrediting them?

As we saw with the Posey trial and the Clyde Woods trial if you leave the investigation up to the police and DAs office justice will never be done.

Yes the victim will be put on trial just like the Posey family was. The violent history of James Allen is relevant. It is relevant that an incompetent local judge against the wishes of the Deputy DA failed to revoke Allen's bond for re-offending while out on bond. Had this moronic judge done what was asked Allen would still be alive today awaiting trial for violence.

BTW Bill before did you even call the bank before encouraging people to give to the fund to see who set up and had ownership of the account? It seems to be a bit reckless on your part if you did not do this.

First of all, I did not make any reference to a bank account at Bank 34 when I wrote the story. This was an insert by the editor and not me.

Secondly, what does his children have do do with dividing money? It seems to me that any money collected should go toward helping the family make Mr. Allen's final arrangements. I a not advocating that the citizens of Alamogordo make a monetary gift to the family to be divided among them. I merely suggested that it would be a nice jesture to help them deal with his death. If a bank or for that matter Bank 34 is involved in the administration with this they would be the ones to make the payments to the funeral home etc... and anything that is left over could either be set aside in a special account for the education needs of his kids or put into a special fund to help others in similar circumstances.

Come on Queen, this isn't about his court records or how many kids he had. It was a senseles death that will affect his neighbors, his family, and our community in ways that no one knows about yet.

It would have had to be a family member though. Seems like Queen has picked you as her victim for the day, I'll leave you to it. BTW, other than the words "Alleged Killer" ( we know he did it) the piece is ok. I do understand, for legal reasons, you needing to use the word "alleged", but you are going to get some comments on that.

He did not set up the account. He did not put the mention of it in his article.

If it is true that you meant the money would go towards funeral arrangements then wouldn't the sensible thing to do would be to make checks payable to the funeral home? The bank would not be in charge of making payments to the funeral home as it is a bank account not a trust account.

I know we will never see eye to eye on this even after the case goes to trial. But you will see the victim will be put on trial. Everything that led up to the event will be brought up in trial. The alleged relationship between the other victim and her confiding in the abuse to Hardegree will be brought up in trial. Just as the Posey's were put on trial so will James Allen.

It is a legal issue. he has not been tried or convicted as of yet and if the word "alleged" is not used his attorney could use that as a move for any number of things including a change of venue, or the charge that he has been tried and covicted in the press before coming to trial.

You are dead wrong. The family is united. All 3 mothers are united and together. They are all 3 friends and want their kids to be close especially now. In fact, everyone is meeting and most are staying at Tiffany's house (a mother). There is no bickering among the women, just crying. No, the family doesn't know who opened the account. No Queen of Foo, no attorney needs to get involved and take a cut of the money. Jim's Dad needs to be contacted. Anyone can go to Jerry's bar to contact him. They have his direct number to his cell phone. The grandfather will make sure the money goes to who it needs to go to. He loves all 6 of his grandkids. They are all he has left of his son now. Mr Allen is also retired air force. Jim was honorably discharged from the air force. Mr Hardegree, is getting credit for being a retired military man, when Jim's Dad was too. Hardegree stole the life of Mr Allen's son and should be looked at as a ruthless criminal.

No one wrote that the other victim confided in any abuse to Hardegree. What was written was that Sheila was a pot stirrer and that is exactly what she did. She slept around with everyone and always tried to get fights going. Jim didn't want her anymore and she was whining to Hardegree. Queen of Foo, don't add to things that are not written here. I thought you said you were about the facts not gossip? You are now gossiping.

Yep, there is not going to be a problem with the kids getting equal amounts. The mothers are united together and it is all about the kids, they all love the kids as if they were their own. I agree, there does not need to be a lawyer, just more money lost for the kids.

So if an attorney was to volunteer their time setting up a trust I take it the family would not be interested in that either?

Thank you so much for this article. These children will have so much to deal with for the rest of their lives and all anybody cares about is what Mr. Allen did or did not do. While his life may not have meant much to most people, he meant everything to these children. He was a good father!!

They do want it done in the best way possible for the children.

You might want to correct that. The account at bank 34 is a fraud. His family did not set that one up. The account for his family is at wells fargo and the real donation jars are at jerry's not anywhere else.
