An Alamogordo man charged in a violent shooting rampage last week that killed his neighbor and left one woman wounded has been arraigned in Magistrate Court.

ALAMOGORDO The only sign here that pilots from Holloman Air Force Base are engaged in the NATO bombing in Kosovo is waggled at motorists by Tim Hardegree.

"No more! Hitlers. Go NATO. Go 49th," says the big placard it covers him from his knees to his chin that Hardegree hoists in front of himself at the busy downtown intersection of 10th Street and White Sands Boulevard.

White Sands Boulevard, also known as U.S. 70, is Alamogordo's strip of motels, convenience stores and fast food restaurants.

Some, but not most, of the drivers honk or wave encouragement at Hardegree as they pass by.

Some, but not most, are going to or coming from the air base, whose main gate is just off U.S. 70 about eight miles southwest of town.

Nobody stops to join Hardegree's one-man cheering section.

For an hour or so during Monday's evening rush hour, nobody even stopped to talk with him.

Maybe it's because he's new in town.

Hardegree, 40, said he served 20 years in the Air Force before retiring three years ago. He was, he said, an engine mechanic for F-16 fighter jets.

He got out of the Air Force in Alaska, then lived in Phoenix until moving to Alamogordo a little more than three months ago.

He has friends in Alamogordo, he explained. And he liked it here when he was stationed at Holloman for a time early in his military career.

Hardegree said he was "stunned" when he heard that one of the F-117A stealth fighters deployed by Holloman's 49th Fighter Wing had been downed possibly by a surface-to-air missile near Belgrade on Saturday.

"They were so successful in Iraq during the Gulf War," he said. "They never came back with even a bullet hole, much less get shot down, if that's indeed what happened."

Hardegree added that he was "glad the pilot got rescued immediately, rather than having to eat bugs in the woods for six days."

He said he has been told by some in town that he's wasting his time. "I'm retired," he said, "it's my time to waste."

Although new to Alamogordo, he is not an entirely unfamiliar sight to local drivers.

During the recent Senate impeachment trial of President Clinton he stood on the same corner, by himself, with an "Impeach Clinton!" sign.

Actually, he's still using the same sign. He has just covered up the Clinton criticism with newspaper and written his new slogans on the other side.

"I despise him," he said of Clinton. "But I support his decision" to authorize airstrikes against Serbia.

I just searched AK and AZ court records and turned up nothing. No divorce, no traffic, no nothing. In AK not all the courts are online so maybe there is still something up there.

Thanks for posting the article on Hardegree it helps to show his personality I am very surprised there was nothing on him from other places he has lived and I am wondering if this was a common practice of his (holding signs on the side of the road). I just can't imagine he would move to Alamogordo and start this.

Thanks Foo, I remember this article from years ago. I know now why his name seemed familiar to me.

"How dare you even suggest the man has PTSD." How dare you? And at the same time making a constitutional argument? As usual you misrepresent the law. Here is what our Constitution actually says on the matter:

"Sec. 14.[Indictment and information; grand juries; rights of accused.](1993)

No person shall be held to answer for a capital, felonious or infamous crime unless on a presentment or indictment of a grand jury or information filed by a district attorney or attorney general or their deputies, except in cases arising in the militia when in actual service in time of war or public danger. No person shall be so held on information without having had a preliminary examination before an examining magistrate, or having waived such preliminary examination."

See the PH or PE is a right under an information which is an accusation signed by the DA. There is no such right in the case of an indictment. So, just where to you find these nuggets?

Hello To All, Yes he did carry a few different signs on did say nuke the skum. I am still very upset by all this and can only say at this point, I hope it comes to an eye for an eye. And that justic is fair. R.I.P Let's all remember to enjoy the time we do have left on earth and try to live our lives with no regrets. Peace Out Big Red.

NICELY put! I hope some other people will catch onto your way of thinking. Even if he did have it, it is his responsibillity to get help. Not go and murder your neighbor and then claim an insanity defense because you dont want to take the true punishment you deserve. As soon as the constitutional process is done and he is convicted, he should die.

Those are all good things to do. I think though, our first order of business should be to make an example out of our murdering neighbor. Mr. Morris: I know you are friends with Ceballes and are gullible enough to buy all of his bs, but that is a right in New Mexico Guaranteed by the Constitution of New Mexico and the New Mexico Bill of Rights.
But how did you refer to these people like me on the other topix..oh like showing a caveman a cigarette lighter. Can you say UGH!!! These nuggets are called common law and if you did a little research you would see that in the supreme court library you can find a lot of cases that deal with this, if you are resourceful enough. I will give you an example:
The preliminary examination is more than just a rule of procedure available to either side in a dispute. It is included in the Bill of Rights section of the New Mexico Constitution. The proviso stands shoulder to shoulder with the most basic guarantees of individual liberty against the power of the state, such as the right of self-government (art. II,§ 3), the right to life, liberty and property (art. II,§ 4), the right of habeas corpus (art. II,§ 7), the right to bear arms (art. II,§ 6), the freedom of elections (art. II,§ 8), and the freedoms of speech, press, and religion (art. II,§§ 11, 17). Even within Article II, Section 14 itself, in addition to providing for an accused's right to a prelimnary hearing , the Constitution guarantees in the same breath an accused's right to appear and defend, the right to counsel, the right to confrontation, and the right to a speedy and impartial trial by jury. Simply put, these are not mere matters of procedure to be utilized by either side as they see fit. They are guarantees of liberty to be invoked by the accused in a criminal prosecution, as the accused sees fit. See State ex rel. Clark v. Johnson , 120 N.M. 562, 570, 904 P.2d 11, 19 (1995)("'State constitutions are not grants of power to the legislative, to the executive and to the judiciary, but are limitations on the powers of each.'" (quoting State ex rel. Hovey Concrete Prods. Co. v. Mechem , 63 N.M. 250, 252, 316 P.2d 1069, 1070 (1957), overruled on other grounds by Wylie Corp. v. Mowrer , 104 N.M. 751, 726 P.2d 1381 (1986))); cf. State v. Alingog , 117 N.M. 756, 760, 877 P.2d 562, 566 (1994)("While the state does not have the fundamental rights granted an individual under the Bill of Rights and the Due Process Clause, application of the doctrine of fundamental error to avoid a miscarriage of justice well may be available to the state."). Thus, the context of the preliminary hearing proviso, both within Article II, Section 14 and within the common understanding of what is meant by a Bill of Rights section to a constitution,{*379} provides us additional comfort in the correctness of our decision not to read into the Constitution that which is clearly not there. STATE EX REL. WHITEHEAD V. VESCOVI-DIAL, 1997-NMCA-126 , 124 N.M. 375 , 950 P.2d 818.
Maybe that will let you know you are not as smart as you say you are or maybe all of us regular people are not a dumb as you think we are.
By the way the PTSD comments were from your QOF in the other topic in the first page, remember when you called all the other people other than yourself cavemen. If you do a little research you might learn something and if you listen rather than speak louder you may also learn something. Maybe you should learn something before you open your mouth on things you do not know about. This is Scot Key and Ceballes way of choosing a forum which they are mandated by the New Mexico Constitution to get a waiver signed by the defendant as he alone can waive that right, not the DA. Hey Caveman: It was your wifey you tried to make everyone believe Hardegree has PTSD, not me. Do you finally understand the concept of a "right?" If Hardegree is guilty, a sharp attorney could get him off because Ceballes illegally waives preliminary hearings for the accused. I don't know if he tricked Hardegree into signing a waiver but Ceballes usually just claims the accused has waived his right when he hasn't. That's what he does. To make this really clear, even for you, once a person is arrested and arraigned he/she cannot go before a grand jury UNLESS they the accused, and they alone, sign a waiver or the DA dismisses the charges, gets an indictment from the grand jury and re-charges him. Do you want a murderer to go free, if he is a murderer just because Ceballes is a cocky egomaniac who ignores the law and makes his own? Bite me.

You do not "get injured" by PTSD. It is a disorder caused by severe trauma which can happen to anyone, anytime, any place and at any age.
