Condo associations want plan to make owners pay

Full story: Columbus Dispatch

The foreclosure crisis is threatening to hurt even condominium owners who are up-to-date on their payments, as cash-strapped neighbors and vacant units drain thousands of dollars in fees intended for the upkeep of their communities.

I have no sympathy for condo/home associations since most of them are run by out of control zealots who go after good honest people for the tiniest infractions. If they want to be higher on the pecking order, they should agree to some oversight where an owner can appeal their claim, similar to what a supreme court is to a municipal court. Right now they can get away with anything since nobody is watching them.

I've worked with 2 different condo associations and I've never seen them as being run by "out of control zealots". Both that I've worked with, and others that I know of, are associations comprised of the residents with a board elected by majority vote of all residents on an annual basis.

The statement "... they can get away with anything..." is a gross exaggeration, since all members who bother to attend the monthly association meetings are "watching them". The problem comes from the residents who can't be bothered to attend the meetings and then complain that they didn't didn't have a voice in the decision.

Our association has been very successful with collecting our fees since we hired Kaman's firm. He posts status updates on the super lien project on his website - www.ohiocondolaw.com

1) Any individual condo owner would have standing in court. There is no absolute reason that an attorney would have to be retained. 2) Condo owners are contractually bound by the terms of the association. These terms are disclosed, and agreed to, at the time of purchase. 3) I can think of absolutely no reason why a condo association should receive preference to collect its dues.
