That is all true. But as I said before, the SCOTUS refusing to hear the Prop 8 case could have indirect influence on other courts confronting a similar issue. It's known as lateral precedent, and while in no way binding, it exists nonetheless.
In addition, depending on HOW the SCOTUS turns down the case- i.e. with comment, without comment- it CAN set precedent as it did in Baker v Nelson.
