Federal recognition is on a much faster track than state that in the states and should be a reality in the next 1-2 years. Challenges to the federal DOMA statute have already been filed in Massachusetts and Connecticut with more sure to follow from Iowa and Vermont. These cases put the administration on the spot regarding the campaign promise to seek its repeal and how willing they are to fight against them will be an indication as to what their position really is. These cases stand a really good chance of overturning the DOMA provisions which prohibit legal federal recognition, whether the Justice Dept fights them or not, but depending on the level of fight will determine how long that will take to happen. There is talk in Congress about voting for its repeal, but its on the back burner if on the stove at all. Aside from the Iowa ruling and the Vermont veto override, a little noticed advance last week is going to push the issue right in front of Congress and that is DC's passing a statute which extends marriage recognition to couples married in other jurisdictions and a promise by the city's Council to grant full equality by this summer. Given that Congress has the final word on District home rule and any laws passed to govern it, they're going to have to consider the issue whether they want to or not and the fate of the District's ordinance will give us a clearer picture of how likely DOMA is to survive when it comes up eventually. The states are a different issue altogether and a much steeper road to climb. While we've met with success in Vermont and Iowa and with a good chance in New Hampshire and possibly Maine and New York, as well as with everything but the name likely in Eashington and possibly Nevada, the future from there isn't as clear. The federal get out of court free card issued to the states by DOMA makes many of the other state's laws and amendments virtually untouchable without repeal. Even if we do win in New York, a federal interest in the cause of overturning the DOMA FF&C immunity and in turn the remaining state laws and amendments won't be all that clear cut and a Loving v Virgina type case would still be years off.

Federal recognition will come in less than 3 years I beleive. The Democrats could repeal it in 20 minutes if they really wanted to. If they don't repeal it, then DOMA will be found to be unconstitutional by a federal judge, because it certainly violates a number of U.S. Constitutional provisions. When that happens, I hope the present administration will not appeal that wise judge's ruling to SCOTUS.
