It would only be a murder if he is guilty and convicted of 1st degree murder in our screwy legal system. Right now, it is just a death, not a murder. The press needs to report the facts, not an opinion.

Law enforcement rule deaths by different categories: suicide, natural, homicide. A murder is the manner in which a person died. The media is not reporting opinion. If so, they could be sued for libel. A murder is fact. You can check with law enforcement, medical examiner, arrest affidavit...etc. If Bogart is never convicted of the murder, it doesn't change how Hernandez died. It will always be classified as murder no matter who is guilty for it.

Things arent adding up right now. I just hope that Cristina has enough courage to be 100% honest about her and Jayes history and about the events that took place that night instead of trying to salvage Jayes legacy, if that is indeed the case. The truth will answer a lot of questions about their lifestyle and the events that led up to this unfortunate situation. I will pray in biblical proportions for all that are involved. Coming clean is the only thing that will set her mind free. I cant even imagine the situation that she feels shes in between the Hernandez family and the lifestyle that they led...This is very unfortunate. God Bless You All!!!!

I believe the facts are true in this paper. Mrs.Hernadez "stories' are not matching up? i don't understand the fact that some "man" would protect Mrs.hernandez when mr.Hernandez was obviously not abusive to her.

He may not have been an angel but he was a very good person until he met Kristina. This is something i'm sure she is very happy about but needs to put up a front of sadness until the heat is off. We may never know the whole truth but she will have to live with herself. She will move on to do what she is good at so beware all men you could be next. Oh yeah and women too.

Isn't it suspisious that Mrs. Hernandez changed her story???? I wonder why??!
Mrs Hernandez should stick to the facts and be 100% honest. How could she live the rest of her life knowing that Jimmy gave his life for her without second thoughts...
In the newspaper everybody is saying that 'J' was a great guy IN HIGH SCHOOL!!!...we're talking about over 10 Years ago!!! I don't see any current information about 'J'.
J was a Iraq veteran but we don't know how he came back from the war... we don't know how his mental condition was... DO WE??
Christina don't be a B****H and say the truth!

A death being defined as a MURDER has NOTHING to do with a man's conviction. Jeremy did not kill himself (suicide), he was not accidentally killed (homicide), he was MURDERED by another human being. Why dont you educate yourself before you post something.

Also, in regards to Jeremy's character after high school.... he was a great man that had some issues, just as any other war vet, but he was a great man.

My deepest condolences go out to Mom, Dad, Sister, Wife, and the rest of his family and friends.

How can someone blame the wife? I would like the people blaming the wife, to go see the her. I don't see how one can say it's all a front and she's pretending to be affected. She can't sleep, can't keep from crying. How dare you all!

I have seen her and she never shed a tear the entire time I was there. Unlike Jeremy's mother who is so visibly hurting. I'm not saying she (Christina) did it or had anything to do with it but she didn't come across as the grieving widow you'd like to make her out to be.

I think all of you should step back and let "Justice be served and I MEAN ALL OF YOU! Let "J" R.I.P. and, have some consideration of the family who loved him and are still grieving ...

LAS CRUCES PEOPLE YOU HAVE NO HEART " AT ALL" !!!

This is an unfortunate loss to the family. Nobody should lose a loved one this way - no matter what.

I hope for the best trial and rightousness for Jaye and his family.

Any way you look at it, this is a bad situation. Will anyone ever know what really happened? Probably not, especially if drugs/alcohol were involved. What's happened has happened. We can't change the outcome. Jeremy and Jimmy both have famiy and friends who love and care for them. We can not judge either one because we were not there.

For those that truly love the family, J's visitation is Wednesday from 5 to 7 at Immaculate Heart followed by a funeral mass. Funeral services are on Thursday at the same church at 1 p.m. Full military honors at burial.

In reference to the person that inquired as to what Jaye's character was 10 years after high school, I can offer some insight. My friendship with Jaye began about 1 year ago. He was an angel and caring friend to all of the people he held close. If you really knew Jaye, even up until his death, you can attest to this truth.
He lived a bold, daring and beautiful life. A life of freedom that he helped ensure....and for all who question it; He loved his wife, and she loved him, fiercely, passionately and into infinity.

My prayers goes to the family's loss. It's a situation no one would like to be in.When I heard I was in shocked, now just to imagine what the wife and james experienced as they saw Jaye fall to the floor. Imagine what jaye was going through when he saw the bullets coming towards him. Pretty frightning for all three.Unfortunately, it hapened, and can't be undone. Now the truth will begin to kick in.If anyone was mistreated, the truth will be out!But atleast for now until we are all recovered from this tragedy, our deepest condolence goes to the Hernandez Family from all the people who have posted comments.

Well, you're all still missing the correct terminology.
The state Office of the Medical Investigator will never rule a death a "murder." The ruling will be "homicide."
Someone may be charged with "murder," and eventually convicted of "murder." Then it's a murder.

But it is factually wrong to refer to the third "murder" of the year. Use "homicide," "slaying," "shooting death."

Could you please show some respect for my best friend Jaye. I miss him and its hard reading all this stuff you people are writing. I have know him for the last 5 years and he has been nothing but a good friend. Let the police figure out what happend and keep you mouth shut about what you think you know. Thanks
